Pursuant to section 1.2.1 of the OM&A, <br /> <br /> "Eugene shall only make capital expenditures or outlays that are within the limits of the budget approved pursuant to <br /> <br />Section 3.1, below, and that are made using Eugene's adopted procurement and contracting procedures." <br /> <br />Thus, the question comes back to whether the budget contemplates the work needed to be done or not. If the budget <br />does <br /> have a provision for the expenditure of the funds necessary to raise the manholes then the work can be completed <br />do not <br />pursuant to the OM&A. If, however, the expenditure of these funds have a connection to the budget then, <br />pursuant to Section 1.2.1 of the OM&A, the CoE and the MWMC will need to discuss whether the budget can be adjusted <br />to provide room for the manhole work. In the event an agreement cannot be reached then the matter would be resolved <br /> <br />via arbitration. <br /> <br />With respect to whether an IGA for this particular project is required my response is "no, I do not believe an IGA is <br /> <br />necessary." <br /> <br />I am scheduled to be out of the office until the 9th of July and have cc'd my associate, Caitlin O'Donnell, on this email in <br /> <br />the event further discussions are needed prior to the 9th. <br /> <br />2 <br /> <br />
