PQNAI <br />4.3 <br />URCHASES FROM UALIFIED ONPROFIT GENCIES FOR NDIVIDUALS <br />WD. <br />ITH ISABILITIES <br />4.3 .1 IG. <br /> Pursuant to Eugene Code 2.1430 and in accordance with ORS 279.835 <br />NENERAL <br />through 279.850, if Goods or Services needed by the city are available in a timely <br />manner from a Qualified Nonprofit Agency for Individuals with Disabilities, the city <br />shall obtain the Goods or Services from the qualified Nonprofit Agency in accordance <br />with the provisions of ORS 279.835 through 279.850. <br />4.3.2C. <br /> If Goods or Services are available from more than one such agency, <br />OMPETITION <br />the Solicitation Agent shall award a contract to the agency with Goods and Services <br />that best meet the needs of the city. <br />4.3.3WNA. <br /> The provisions of this paragraph do not apply to Personal <br />HENOTPPLICABLE <br />Services Contracts or Concession Agreements. <br />PIC. <br />4.4 <br /> Unless a Public Improvement contract qualifies <br />UBLIC MPROVEMENTONTRACTS <br />for award under another classification, it shall be awarded under the classifications <br />described in this Section 4.4. <br />4.4 .1 L-CP. <br /> The city shall make every effort to construct Public <br />EASTOST OLICY <br />Improvements at the least cost to the city. <br />4.4.2MAAPI. <br /> Unless otherwise provided in <br />ETHOD OF WARD FOR NYUBLICMPROVEMENT <br />these regulations or approved for a special exemption, Public Improvement contracts <br />in any amount may be issued only under an Invitation to Bid. <br />4.4 .3 EN-BPI. <br />VALUATION OF ONIDUBLIC MPROVEMENTS <br />4.4 .3 .1 When Report Required. <br /> Upon completion of and final payment for any Public <br />Improvement contract, or class of Public Improvement contracts, in excess of <br />$100,000 for which the Solicitation Agent did not use the competitive bidding <br />process, the Solicitation Agent shall prepare and deliver to the city council an <br />evaluation of the Public Improvement contract or the class of Public <br />Improvement contracts. <br />4.4 .3 .2 Contents of Report. <br /> The evaluation shall include but is not limited to the <br />following matters: <br />(a) The actual project cost as compared with original project estimates; <br />(b) The amount of any guaranteed maximum price; <br />(c) The number of project change orders issued by the city; <br />(d) A narrative description of successes and failures during the design, <br />engineering and construction of the project; and <br />Article 4 Classes of Contracts Page 9 <br />Exhibit A to Administrative Order No. 44-08-06-F <br /> <br />
