ARTICLE 4 <br />CLASSES OF CONTRACTS AND METHODS OF AWARD <br />RUC. <br />4.1 <br /> The following Purchasing Agent rules apply to <br />ULES FOR SE OF LASSIFICATIONS <br />the determination of classification and record of method of award. <br />4.1.1 DC. <br /> As provided in ORS 279B.065, 279B.070, and Section <br />IVISION OF ONTRACTS <br />132, Chapter 794, Oregon Laws, 2003, no Procurement or Contract or Public <br />Improvement may be artificially divided into parts or phases for the purpose of avoiding <br />any competitive Solicitation requirement that would otherwise apply. <br />4.1 .2 MBCP. <br />ETHODS ASED ON ONTRACT RICE <br />4.1 .2 .1 Contracts Other than Public Improvements. <br /> A Contract for the purchase of <br />Goods or Services or construction Services other than Public Improvements or a <br />contract for personal services may not be awarded under a method based on <br />Contract Price or estimated Contract Price if the actual Contract Price exceeds <br />the maximum price allowable for the method. Therefore, if Offers or Quotes <br />exceed the method threshold, the Solicitation Agent must cancel the Solicitation <br />and may re-issue a Solicitation under a method appropriate for the probable <br />Contract Price. <br />4.1 .2 .2 Public Improvement Contracts. <br /> When the appropriate Solicitation Method is <br />based on an estimated Contract Price, the estimated Contract Price shall be <br />calculated to include the full cost of all Goods, Services, materials and labor <br />then anticipated to be acquired plus a reasonable contingency against market <br />price fluctuation. The ability to amend a contract is limited as provided in <br />Article 16. If an informal Solicitation Method is selected, and the Quotes <br />received indicate that the likely Contract Price will exceed the price limit for the <br />informal method, the Solicitation Agent shall have discretion to proceed with <br />the Informal Solicitation, subject to the reporting requirements of subsection <br />4.4.3, or to reissue the Solicitation under the method prescribed for the likely <br />Contract Price. <br />4.1 .3 RSM. <br />. Except as otherwise provided in these <br />ECORD OF ELECTION ETHOD <br />regulations, the Solicitation Agent shall record the method used to award every Public <br />Contract and the basis of the award and, unless the award was made pursuant to an <br />Invitation to Bid or a Request for Proposals, of the reasons why the method of <br />selection was deemed in the best interest of the city. <br />CCMA <br />4.2.. <br /> Except where indicated by <br />LASSES OF ONTRACTS AND ETHODS OF WARD <br />the provisions of this Article 4, the classes of contracts described in Sections 4.3 through <br />4.13 and the methods for their award have been established by the Board under Eugene <br />Code 2.1430: <br />Article 4 Classes of Contracts Page 8 <br />Exhibit A to Administrative Order No. 44-08-06-F <br /> <br />
