ARTICLE 16 <br />CONTRACT ADMINISTRATION <br />CI <br />16.1. <br />ONDUCT OF NSPECTIONS <br />16.1 .1 I. <br /> Inspections or tests shall be performed so as not to unduly delay the <br />NSPECTORS <br />work of the contractor or subcontractor. No change of any provision of the <br />Specifications or the contract may be required by the inspector without written <br />authorization of the Purchasing Agent, unless otherwise specified in the Solicitation <br />Documents. The presence or absence of an inspector shall not relieve the contractor <br />or subcontractor from any requirement of the contract. <br />16.1 .2 PI. <br /> The location, timing and manner of inspections shall <br />ROCEDURE FOR NSPECTION <br />be a provided in the contract and under the provisions of subsection 15.4.4. <br />EC. <br />16.2 <br />NVIRONMENTAL ONDITIONS <br />16.2 .1 ECD. <br /> For purposes of this section, an <br />NVIRONMENTAL ONDITION EFINED <br />environmental condition is any physical condition of property that must be reported, <br />analyzed, removed or contained, or that requires other special handling under any law <br />(including, without limitation, statutes, ordinances rules or orders) relating to the <br />prevention of environmental pollution or the preservation of natural resources. <br />16.2 .2 RUL. <br /> If contractor is delayed or must undertake <br />ESPONSE TO NANTICIPATED AWS <br />additional work by reason of existing laws not cited in a Public Improvement contract <br />or due to the enactment of new or the amendment of existing laws relating to the <br />prevention of environmental pollution and the preservation of natural resources <br />occurring after the submission of the Offer under which the contract was made, the <br />city may: <br />(a) Terminate the contract; <br />(b) Complete the work itself; <br />(c) Use nonagency forces already under contract with the city; <br />(d) Require that the underlying property owner be responsible for cleanup; <br />(e) Solicit Offers for a new contractor to provide the necessary Services under the <br />competitive requirements of these regulations; or <br />(f) Issue the contractor a change order setting forth the additional work that must be <br />undertaken. <br />16.2 .3 RUEC. <br />ESPONSE TO NANTICIPATED NVIRONMENTAL ONDITIONS <br />16.2 .3 .1 Immediate Notice to City. <br /> If a contractor encounters an environmental <br />condition not referred to in the Solicitation Documents, not caused by the <br />contractor and not discoverable by a reasonable pre-Bid visual site inspection, <br />Article 16 Contract Administration Page 79 <br />Exhibit A to Administrative Order No. 44-08-06-F <br /> <br />
