prevailing rate of wage and, if federal prevailing wages apply pursuant to the <br />Davis-Bacon Act (40 U.S.C. 3141), the federal prevailing rate of wage required <br />under the Davis-Bacon Act that may be paid to workers in each trade or <br />occupation required for the Public Works employed in the performance of the <br />contract either by the contractor or subcontractor or other Person doing or <br />contracting to do the whole or any part of the work contemplated by the <br />contract. If the Davis-Bacon Act applies, the Specifications shall include <br />information showing which prevailing rate of wage is higher for workers in <br />each trade or occupation. When a Public Works project is subject to ORS <br />279C.800 to 279C.870 and the Davis-Bacon Act, the contractor and every <br />subcontractor shall pay the higher of state or federal prevailing wage. <br />15.6 1 .3 Inclusion in Specifications of Provision Regarding Public Works Bond. <br />The Specifications for every contract for Public Works shall contain a provision <br />stating the contractor and every subcontractor, unless exempt under ORS <br />279C.800 to 279C.870, must have a Public Works bond filed with the <br />Construction Contractors Board before starting work on the project, and must <br />provide the city with the statement certifying the Public Works bond has been <br />filed, as required by 15.1.4.2. <br />15.6 .1 .4 Inclusion in Contract of Provision Regarding Public Works Bond. <br /> Every <br />contract for Public Works must contain a provision requiring the contractor: <br />(a) To have a Public Works bond filed with the Construction Contractors <br />Board before starting work on the project, unless the contractor is exempt <br />under ORS 279C.800 to 279C870; <br />(b) To include in every subcontract a provision requiring the subcontractor to <br />have a Public Works bond filed with the Construction Contractors Board <br />before starting work on the project, unless the subcontractor is exempt <br />under ORS 279C.800 to 279C.870; and <br />(c) To provide the city with the statement certifying the Public Works bond <br />has been filed, as required by 15.1.4.2. <br />15.6 .1 .5 Fee To Be Paid to BOLI. <br /> The Specifications for every contract for Public <br />Works shall contain a provision stating that a fee is required to be paid to the <br />Commissioner of the Bureau of Labor and Industries as provided in ORS <br />279C.825 (1). The contract shall contain a provision that the fee shall be paid to <br />the commissioner under the administrative rule of the commissioner. <br />15.6 .2 LV. <br /> If a public agency fails to include a provision that the <br />IABILITY FOR IOLATIONS <br />contractor and any subcontractor shall comply with ORS 279C.840 in the <br />advertisement for Bids, the request for Bids, the contract Specifications, the accepted <br />Bid or elsewhere in the contract documents, the liability of the public agency for <br />unpaid minimum wages, is joint and several with any contractor or subcontractor that <br />had notice of the requirement to comply with ORS 279C.840. <br />Article 15 ContractsPage 78 <br />Exhibit A to Administrative Order No. 44-08-06-F <br /> <br />
