preference given to that bidder in the state in which the bidder resides. For the <br />purposes of administering this section, the city shall rely on information published <br />annually by the DAS. <br />11.6 .8 LTB. <br /> Low tie Bids are Bids from Responsive and Responsible bidders that <br />OWIEIDS <br />are identical in price, fitness, availability and quality and that meet all the <br />requirements and criteria set forth in the Bid Documents. Low tie Bids shall be <br />awarded as follows: <br />(a) The city shall prefer Goods or Services that have been manufactured or <br />produced in this state pursuant to ORS 279.021(1); or if still tied <br />(b) The city shall then prefer the bidder whose principal offices or headquarters are <br />located in Oregon; or if still tied <br />(c) The city shall then select the successful bidder by drawing lots. Such bidders <br />shall be given notice and an opportunity to be present when the lots are drawn. <br />(d) If none of the tied bidders is located in Oregon, award of the Contract shall be <br />made by drawing lots. Such bidders shall be given notice and an opportunity to <br />be present when the lots are drawn. <br />A. <br />11.7 <br />WARD <br />11.7 .1 NIA. <br /> Unless otherwise provided in the Bid documents, <br />OTICE OF NTENT TO WARD <br />the Solicitation Agent shall issue to all bidders, or post electronically or otherwise, a <br />notice of the city's intent to award the Contract. The notice of award shall not be final <br />until the later of the following: <br />(a) Seven (7) days after the date of the notice, unless a longer period to file a protest <br />of award is provided in the Solicitation Documents; or <br />(b) Until the Purchasing Agent provides a written response to all timely filed <br />protests, if any, that denies the protest and affirms the award; or until any appeal <br />of the Purchasing Agent’s decision regarding a protest has been reviewed by the <br />city manager. <br />11.7 .2 PECDB. <br /> Unless a longer <br />ROMPTXECUTION OF ONTRACT AND ELIVERY OF ONDS <br />period is provided in the Bid documents, successful bidder shall furnish insurance and <br />deliver all required payment and performance bonds and execute the contract within <br />ten (10) days after the date of issuance of the notice of intent to award.
