Section 5: Use <br />5.1 Use of Multi-Purpose (Artificial Surface) Athletic Fields. <br />(1) The Field Use Matrixes included as Appendix A shall govern the respective use by <br />City, District and community of the multi-purpose artificial athletic fields. For the purposes of <br />the scheduling matrixes in Appendix A, and only for that purpose, "community" includes events <br />sponsored by City as well as by community groups. Times reserved for the District, but not used <br />by the District, will be made available to City and Community and times reserved for the <br />community, but not used by the community, will be made available to District. Changes in policy <br />that relate to the use of the multi-purpose artificial fields will require the review and approval of <br />the User Committee. The User Committee will determine how scheduling is to occur during the <br />times reserved for community use. <br />(2) The matrixes included in Appendix A were developed using existing requirements of <br />the Oregon School Activities Association (OSAA) and local youth sports organizations. City and <br />District reserve the right to renegotiate the actual times of District and community use if there <br />are changes in these requirements. The intent of the parties is to maintain a balance between <br />the number of times reserved for the community and for District substantially the same as in <br />Appendix A, with the potential for modification as described under Section 3.1 <br />5.2 Other Athletic Fields. Use of athletic fields other than artificial surface fields in the <br />Youth Sports Parks will be determined by the User Committee, except that they will be scheduled and <br />used during instructional days in a manner that is compatible with District instructional needs. <br />Instructional days are those days scheduled by the school board for instruction. <br />5.3 Change in Policies Governing Usage. Any proposed change to usage or policies <br />governing usage other than scheduling will require approval by City and District after consultation with <br />the User Committee. <br />5.4 User Committee. While City and District are responsible for the joint management of <br />the artificial surface fields and Youth Sports Parks, they will maintain a User Committee to oversee the <br />scheduling and use of the artificial surface fields and Youth Sports Parks, and to make recommendations <br />to City and District on policies relating to the fields and parks. The User Committee's operations and <br />decisions will be consistent with this Agreement and the provisions specified below: <br />(1) The User Committee will not have more than twelve (12) members and will consist <br />of an equal number of District and City representatives and at least one representative each <br />from Kidsports and one other major community user, to be selected by each respective <br />organization. The City Manager and Superintendent of Schools shall jointly designate the other <br />major community user. <br />(2) The City Manager and Superintendent of Schools shall each appoint an equal <br />number of representatives to the User Committee. <br />(3) The User Committee shall meet regularly, but no less than once per year. <br />Amended and Restated Intergovernmental Agreement 2008-01033: Joint Use and Development of Youth Sports Parks and Athletic Fields <br />Page 4 of 11 July 1, 2008 <br />
