be construed to impose upon Landlord any duty of repair of the Leased Premises or Building <br />except as otherwise specifically provided for herein. <br />21, Surrender or Abandonment of Leased Premises. <br />21.1 Surrender of Possession. <br />Tenant shall promptly yield and deliver to Landlord possession of the Leased <br />Premises at the termination of this Lease. Landlord may place and maintain a "For <br />Lease" sign in conspicuous places on the Leased Premises not more than sixty (60) <br />days prior to the termination of this Lease. <br />212 Abandonment. <br />Should Tenant vacate or abandon the Leased Premises or be dispossessed by <br />process of law or otherwise for more than five (5) business days, such <br />abandonment, vacation or dispossession shall be deemed a breach of this Lease, <br />and, in addition to any other rights which Landlord may.have, Landlord may remove <br />any personal property belonging to Tenant which remains on the Leased Premises <br />and store the same, the cost of such removal and storage to be charged to the <br />account of Tenant. <br />22. Attorney's Fees and Court Costs. <br />The prevailing party shall recover from the losing party, attorney's fees and costs if an attorney is <br />hired to collect the rental due herewith or to enforce compliance with any of the terms, covenants or <br />conditions of this Lease. The losing party promises and agrees to pay the prevailing party's <br />reasonable attorney's fees and costs even though no suit or action is filed hereon. However, if a <br />suit or action is filed, the amount of such reasonable attorney's fees shall be fixed by the court or <br />courts in which the suit or action, including any appeal therein, is tried, heard or decided. Such <br />sum shall include an amount estimated by the court as the reasonable costs and fees to be <br />incurred by the prevailing party in collecting any monetary judgment or award or otherwise <br />enforcing each order, judgment or decree entered in such suit, action or other proceedings. <br />Attorney's fees and costs include those attorney's fees and costs incurred seeking relief from stay <br />in bankruptcy courts. <br />23. Holdover. <br />Any holding over by Tenant after the expiration of the Term hereof, with Landlord's consent shall <br />be construed to be a tenancy from month-to-month at the rents and on all of the terms and <br />conditions set forth herein, to the extent not inconsistent with a month-to-month tenancy; provided, <br />however, the Monthly Base Rent, at Landlord's discretion shall equal up to one hundred and fifty <br />percent (150%) of the Monthly Base Rent in effect immediately prior to such month-to-month <br />tenancy. <br />24.
