may impose an additional charge upon Tenant to compensate for the removal <br />thereof. The determination of "normal" under the provisions of the preceding <br />sentence shall be made by Landlord in good faith. <br />10.6 Landlord's Duties. <br />Landlord shall not be in default under this Lease or liable for any damages resulting <br />from or incidental to, nor shall it be an actual or constructive eviction of Tenant, nor <br />shall the rent be abated by reason of: <br />(a) The interruption of use of any equipment in connection with the furnishing of <br />any of the services described in this Section 10; <br />(b) Failure to furnish or delay in furnishing any such services when such failure <br />or delay is caused by accident or any condition beyond the reasonable <br />control of Landlord, including the making of necessary repairs or <br />improvements to the Leased Premises or to the Building; <br />(c) Any limitation, curtailment, rationing or restrictions on the use of electricity, <br />water, gas or any other form of energy serving the Leased Premises or the <br />Building; or <br />(d) Failure to make any repair or to perform any maintenance, unless such <br />failure shall persist for an unreasonable time after written notice of the need <br />for such repair or maintenance is given to Landlord by Tenant. Landlord <br />shall use reasonable efforts to remedy any interruption in the furnishing of <br />such services. <br />10.7 Conservation. <br />Tenant shall use its best efforts to conserve heat, air conditioning, electricity and <br />water usage on the Leased Premises. <br />11. Signs. <br />Tenant shall not place or allow to be placed on the exterior walls of the Leased Premises or upon <br />the roof or any exterior door or wall or on the exterior or interior of any window thereof any sign, <br />awning, canopy, marquee, advertising matter, decoration, letter or other thing of any kind, without <br />the prior written consent of Landlord. <br />12. Liens and Encumbrances. <br />(a) Tenant shall keep the Leased Premises and the Building free from any liens <br />or encumbrances arising out of any work performed, materials furnished or <br />obligations, incurred by Tenant, and shall indemnify and hold Landlord <br />harmless from any and all costs, liability or expenses (including attorneys' <br />fees) arising therefrom. <br />(b) Tenant may withhold. payment of any claim in connection with a good-faith <br />dispute over the obligation to pay, as long as Landlord's property interests <br />are not jeopardized.
