C. Litigation/Arbitration: Services to be provided for <br />advising the City and representing MWMC in the defense of claims <br />made by MWMC's contractors and consultants in the prosecution of <br />MWMC's claims against its contractors and consultants. It shall <br />include representing MWMC in the defense or prosecution of all <br />other litigation/arbitration as directed by City. <br />II. FEES FOR LEGAL SERVICES: Services provided for General <br />Administration shall be billed based on a retainer of $3,000 per <br />month. An itemized record of the time and nature of such ser- <br />vices shall be kept by Attorney. The retainer shall cover all <br />time spent by Attorney up to and including 60 hours per month. <br />In any month in which the time expended for General <br />Administration shall exceed 60 hours, such excess shall be com- <br />pensated at the hourly rates set forth below. <br />Services rendered by Attorney for Design and Construction <br />Activities and Litigation/Arbitration shall be billed on an <br />hourly basis based on the attorney or staff person rendering such <br />services as follows: <br />G. Thrall <br />60.00 <br />per <br />hour <br />Jeffery D. Herman <br />60.00 <br />per <br />hour <br />Other Attorneys <br />their <br />normal hourly <br />rate <br />Law Clerks <br />25.00 <br />per <br />hour <br />No separate charge shall be made for routine secretarial and <br />support services. Attorney shall also bill separately for direct <br />costs incurred including, but not limited to, the following: <br />a. Long-distance telephone calls (actual costs <br />incurred); . <br />b. Photocopying (five cents per copy); <br />C. Travel outside the Springfield/Eugene metropolitan <br />area (twenty cents per mile); <br />d. Expert consultants and witnesses (actual cost <br />incurred); <br />word processing ($25.00 per hour). <br />III. MANNER OF PAYMENT: Payment shall be made to Attorney by <br />City on a monthly basis within ten (10) days after the receipt of <br />Attorney's invoice for services rendered during the preceding <br />month. The invoice shall include an itemized statement setting <br />forth the services rendered and the charges therefor.
