(c) Advising city and representing MWMC regarding <br />condemnation proceedings; <br />(d) Advising City about land use requirements and, <br />with respect to decisions affecting land use, the pre- <br />paration of findings of fact sufficient to support the <br />decision rendered. <br />(3) Permit Acquisition: <br />(a) Advising City and representing MWMC in <br />hearings related to the issuance or modification of WPCF <br />and NPDES permits for the new regional facility; <br />(b) Advising City about permits required by the <br />Oregon Water Resources Board for groundwater, surface <br />water, and "dam" construction; <br />(c) Advising City in relation to proceedings <br />before the Lane County Local Government Boundary <br />Commission regarding extraterritorial extensions of <br />lines; <br />(d) Representing MWMC before the Lane County Board <br />of Commissioners and other public bodies regarding land <br />use matters and other permits. <br />(4) Contract and Grant Administration: <br />(a) Representing MWMC before DEQ, EPA and COE and <br />other administrative agencies regarding eligibility of <br />project costs; <br />(b) Advising City regarding MWMC contract <br />interpretation and contractor performance. <br />(c) Reviewing tort and "lien" claims against MWMC <br />by third parties; <br />(d) Representing MWMC in Contract Claims Review <br />Board proceedings; <br />(e) Advising City about the steps necessary to <br />obtain federal approvals such as for the payment of <br />patent royalties. Negotiating and drafting contracts <br />for the same. <br />(5) Miscellaneous Services: Attorney shall also pro- <br />vide such other services for MWMC as may be requested by <br />City's Director of Public works or his designee. <br />Page 3 - CONTRACT FOR PROVISION OF LEGAL SERVICES <br />
