(13) Advising City about the purchase of real property, <br />temporary construction permits and permanent easements for <br />MWMC; <br />(14) Advising City about the application of the Uniform <br />Relocation Assistance and and Real Property Acquisition <br />Policies Act; <br />(15) Advising City regarding miscellaneous areas such as <br />federal public participation requirements, environmental <br />impact statements, federal inquiries concerning the nature of <br />the project and other matters affecting the performance of <br />MWMC's functions. <br />B. Design and Construction Activities: <br />Services to be provided for Design and Construction <br />Activities shall include services related to procurement, pro- <br />perty acquisition, permit acquisition and contract and grant <br />administration including, but not limited to, the following: <br />(1) Procurement: <br />(a) Reviewing and revising construction, equipment <br />and materials contract documents; <br />(b) Advising City and negotiating with EPA and the <br />Corps of Engineers (COE) over procurement procedures and <br />actions; <br />(c) Reviewing bids for conformity with procurement <br />requirements; <br />(d) Recommending acceptance or rejection of bids; <br />(e) Advising MWMC regarding federal Womens and <br />Minority Business Enterprise (W/MBE) requirements; <br />(f) Reviewing contract documents, bonds and cer- <br />tificates of insurance after final contract award for <br />conformity with MWMC's requirements; <br />(g) Representing MWMC in bid protest proceedings. <br />(2) "Property" Acquisition: <br />(a) Negotiating and document preparation for the <br />purchase of real property, temporary construction per- <br />mits and permanent easements for MWMC; <br />(b) Reviewing and/or drafting contracts with con- <br />sultants for the provision of property acquisition <br />services; <br />Page 2 - CONTRACT FOR PROVISION OF LEGAL SERVICES <br />
