City of Eugene / State of Oregon - Dept of Transportation <br />Agreement No. 25104 <br />6. Both City Project and State Project are scheduled for construction in 2010. The <br />portion of State Project that is in the vicinity of the Garfield Street/West 7th Avenue <br />intersection is in the same vicinity of City Project. City and State have determined <br />that it is to the general public's benefit for State to utilize City resources to <br />accomplish work identified in State Project at the Garfield Street/West 7th Avenue <br />intersection. <br />NOW THEREFORE, the premises being in general as stated in the foregoing Recitals, <br />it is agreed by and between the Parties hereto as follows: <br />TERMS OF AGREEMENT <br />1. Under such authority, State wishes to retain the services of City to construct safety <br />improvements at the Garfield Street/West 7th Avenue intersection, as part of City <br />Project. Safety improvements include, but are not limited to: <br />a. construction of a traffic separator on Garfield Street to prevent left turns <br />from West 7th Place to Garfield Street and to restrict West 7th Place traffic <br />to right-in, right-out; <br />b. closure of the West 7th Avenue crosswalk on the east side of Garfield <br />Street according to the June 15, 2009 State Traffic Engineer crosswalk <br />closure approval memo; and <br />c. installation of striping and signing. <br />Collectively these improvements shall hereinafter be referred to as the "Project" and <br />are shown in the concept design plan attached hereto, marked Exhibit A, and by this <br />reference made a part hereof. The location of the Project is approximately as shown <br />on the sketch map attached hereto, marked Exhibit B, and by this reference made a <br />part hereof. <br />2. The total Project cost is estimated to be $20,000, which is subject to change. State <br />funds, in an amount not to exceed $20,000, shall be used by City on a <br />reimbursement basis for construction only. State shall be responsible for any <br />nonparticipating costs and Project costs beyond the estimate. <br />3. State and City shall track costs to ensure actual costs will not exceed the estimated <br />funding amount of $20,000. Upon approval by State and amendment to this <br />Agreement, the Parties may adjust the scope of work to match available funding, or <br />State may choose to contribute additional funds toward Project. <br />4. The term of this Agreement shall begin on the date all required signatures are <br />obtained and shall terminate upon completion of the Project and final payment or <br />ten (10) calendar years following the date all required signatures are obtained, <br />whichever is sooner. <br />Page 2 of 11 <br />
