Contracts and Agreements <br />No. 25104 <br />City of Eugene Contract #2010-00222 <br />COOPERATIVE IMPROVEMENT AGREEMENT <br />Garfield Street: West 6th Avenue to West 11th Avenue <br />Oregon Route 99 West: Enid Road to Washington/Jefferson Street <br />City of Eugene <br />THIS AGREEMENT is made and entered into by and between the STATE OF OREGON, <br />acting by and through its Department of Transportation., hereinafter referred to as "State;" <br />and the CITY OF EUGENE, acting by and through its designated officials, hereinafter <br />referred to as "City;" both herein referred to individually or collectively as "Party" or <br />"Parties." <br />RECITALS <br />1. Oregon Route 99 West (Pacific Highway West) is a part of the state highway system <br />under the jurisdiction and control of the Oregon Transportation Commission (OTC) <br />and is routed through the corporate limits of the City of Eugene. Oregon Route 99W <br />(OR 99W) is a couplet known as West 7th and West 6th Avenues, within a portion of <br />the limits of this project. Garfield Street and West 7th Place are part of the city street <br />system underthe jurisdiction and control of City. <br />2. By the authority granted in Oregon Revised Statues (ORS) 190.110, 366.572 and <br />366.576, State may enter into cooperative agreements with counties, cities and units <br />of local governments for the performance of work on certain types of improvement <br />projects with the allocation of costs on terms and conditions mutually agreeable to the <br />contracting Parties. <br />3. By the authority granted in ORS 810.210, State is authorized to determine the <br />character or type of traffic control devices to be used, and to place or erect them <br />upon state highways at places where State deems necessary for the safe and <br />expeditious control of traffic. No traffic control devices shall be erected, maintained, <br />or operated upon any state highway by any authority other than State, except with <br />its written approval. Traffic signal work on this Project will conform to the current <br />State standards and specifications. <br />4. Local Agency Supplemental Project Agreement No. 25566, entered into by the <br />Parties on May 12, 2009, defines the scope of work and funding for City's Garfield <br />Street: West 6th Avenue to West 11th Avenue paving project, hereinafter referred to <br />as "City Project". <br />5. State's Oregon Route 99W (OR 99W): Enid Road to Washington/Jefferson Street <br />paving project, hereinafter referred to as "State Project," includes safety <br />improvements in the vicinity of the Garfield Street/West 7th Avenue intersection. <br />Key Nos. 14559 & 16428 <br />
