City of Eugene / State of Oregon - Dept of Transportation <br />Agreement No. 25104 <br />CITY OBLIGATIONS <br />City shall prepare contract documents, advertise for bid proposals, award all <br />contracts, and supervise construction of the Project. <br />2. City shall submit a copy of final plans and specifications to State through the State's <br />Project manager for review and concurrence prior to advertising for a construction <br />contract, or prior to construction if City forces will perform the construction work. <br />Concurrence must be received from State's Area 5 Office and Region 2 Technical <br />Center Office prior to proceeding with the Project. The Project design, signing, and <br />marking shall be in conformance with current State standards and specifications. <br />3. City shall not award a construction contract until State's Project manager has <br />reviewed and approved the low bidder's proposal and costs for Project. <br />4. Upon approval by State, City may adjust the scope of work to match available <br />funding. <br />5. City shall keep accurate cost accounting records. City shall prepare and submit <br />monthly itemized, progress invoices for construction directly to State's Project <br />manager for review and approval. Such invoices will be in a form identifying the <br />Project, the Agreement number, the invoice or account number (or both), and will <br />itemize all expenses for which reimbursement is claimed. Under no conditions shall <br />State's obligations exceed $20,000, including all expenses, unless so authorized by <br />State by an amendment to this Agreement. <br />6. All employers, including City, that employ subject workers who work under this <br />Agreement in the State of Oregon shall comply with ORS 656.017 and provide the <br />required workers' compensation coverage unless such employers are exempt under <br />ORS 656.126. City shall ensure that each of its subcontractors complies with these <br />requirements. <br />7. City shall perform the service under this Agreement as an independent contractor <br />and shall be exclusively responsible for all costs and expenses related to its <br />employment of individuals to perform the work under this Agreement including, but <br />not limited to, retirement contributions, workers' compensation, unemployment <br />taxes, and state and federal income tax withholdings. <br />8. City acknowledges and agrees that State, the Oregon Secretary of State's Office, <br />the federal government, and their duly authorized representatives shall have access <br />to the books, documents, papers, and records of City which are directly pertinent to <br />this specific Agreement for the purpose of making audit, examination, excerpts, and <br />transcripts for a period of six (6) years after completion of Project. Copies of <br />applicable records shall be made available upon request. Payment for costs of <br />copies is reimbursable by State. <br />Page 3 of 11 <br />
