ADMINISTRATIVE ORDER N0.58-02-29 <br />of the <br />City Manager pro tem of the City of Eugene <br />CONCERNING NOTICE OF .INTENDED AMENDMENT OF UTILITY <br />RIGHT-OF-WAY USE PERMITS FEE SCHEDULE TO ADD A PROVISION <br />FOR MAJOR AERIAL INSTALLATION PERMIT FEES, AND PROPOSED <br />REPEAL OF ADMINISTRATIVE ORDER N0.58-01-18-F. <br />The City Manager pro tem of the City of Eugene finds as follows: <br />A. Section 2.020 of the Eugene, Code, 1971 authorizes the City Manager to determine <br />and set fees and charges to be imposed by the City for services, goods, use of municipal property, <br />and licenses and permits. In accordance with the procedures set forth therein, and the further <br />authority of Section 7.300 of the Eugene Code,1971,right-of--way use permit fees have previously <br />been established, the most recent being adopted byAdministrative OrderNo. 58-01-18-F on January <br />30, 2002. <br />B. The Utility Permit Program has an objective to recover the full costs associated with <br />permitting and inspection. Fees necessary to achieve a phased full cost recovery were calculated by <br />City staff and set forth in Exhibit A to Administrative Order No. 58-01-18-F. <br />C. The adopted Utility Right-of--Way Use Permit Fees schedule establishes fees for <br />individual site specific permits and annual blanket permits. Providers that are franchised or licensed <br />by the City may obtain an annual blanket permit for individual service line installations, minor <br />repairs to existing facilities, routine maintenance functions and similar minor recurring activities. <br />The annual blanket facilities permit does not cover the installation of facilities for expansion or <br />upgrade beyond the activities specifically addressed in the blanket permit. A site specific permit is <br />required for all other work activities in the public way not covered under a valid blanket permit. <br />D. The fees established for individual site specific permits were calculated to recover <br />the City's costs in processing individual permit applications. These calculations are based on <br />historic cost date; however, the calculations did not take into account specific activities related to <br />large projects involving the installation of or replacement of primarily aerial facilities only. Staff <br />has therefore recommended that the Utility Right-of--Way Use Permit Fee Schedule be amended to <br />add a section that establishes aper-foot fee for the portion exceeding 26,400 feet (5.0 miles) of <br />specific projects that involve the installation or replacement of primarily aerial facilities only. <br />Projects that involve primarily aerial facilities only that .are less than 26,400 feet would remain <br />subject to the existing fee schedule. <br />E.
