~~ <br />MEMORANDUM OF AGREEMENT <br />BETWEEN THE CITY OF EUGENE AND THE AMERICAN LEGION, POST 3, THE <br />VETERANS OF FOREIGN WARS, POST 293 REGARDING THE DISPLAY OF THE <br />"POW/NIIA" FLAG ON SHINNER BUTTE <br />Contract Number:. 2004-03508 <br />The City of Eugene, in honor of American veterans who are prisoners of war (POW) or missing <br />in action (MIA), agrees to display the POW/MIA in the park area on the south side of Skinner <br />Butte. The display of this flag is limited to the Skinner Butte location only; other City of Eugene <br />facilities or buildings are expressly excluded from this agreement unless a separate agreement <br />exits for that facility or building. <br />In addition, the City agrees to display the flag on six specific dates which bear significance to <br />veterans, POWs, MIAs, and the families and friends of all veterans. These six dates are: <br />a. Armed Forces Day (3rd Saturday in May) <br />b. Memorial Day (last Monday in May) <br />c. Flag Day (June 14th). <br />d. Independence Day (July 4th) <br />e. National POW/MIA Recognition Day (3rd Friday of September) <br />f. Veterans Day.(November l lch) <br />The City further agrees to issue an administrative order directing personnel to raise and lower the <br />- EOW/MIA flag on those six days and to store the flag in a safe and secure place when not being <br />flown. The POW/MIA flag will be flown beneath the American fla on the fl <br />a ole to t <br />ca ed on <br />g <br />gP <br />the south side of Skinner Butte as identified above. <br />The American Legion, Post 3 and the Veterans of Foreign Wars, Post 293, agrees to provide the <br />initial flag and all replacement flags to be flown on Skinner Butte. Any and all maintenance, <br />repair or other such modifications to the POW/MIA flag shall be the sole responsibility of the of <br />the American Legion, Post 3 and the Veterans of Foreign Wars, Post 293. <br />.The City and the American Legion, Post 3 and the Veterans of Foreign Wars, Post 293 agree that <br />the first day to raise the POW/MIA flag will be National POW/MIA Recognition Day 2003, <br />which will occur on September 19, 2003. The parties agree that the City will permit the use of <br />the park area on the south face of Skinner Butte around the flag pole on September 19, 2003 for <br />the initial flag raising ceremony. The American Legion, Post 3 and the Veterans of Foreign <br />Wars, Post 293 have secured the necessary information and permissions for the event on <br />September 19, 2003 and are responsible for the event itself. For any future use of the park on the <br />south face of Skinner Butte in conjunction with the flag raising on any of the six specific dates, <br />permission must be granted to the American Legion, Post 3 and the Veterans of Foreign Wars, <br />Post 293 by the City of Eugene. <br />_ The City of Eugene will provide the hardware to secure the POW/MIA flag to the pole and will <br />t~ rovide the a ui merit necess <br />p q ~p ary to raise and lower the flag on each of the dates listed above. <br />
