ADMINISTRATIVE ORDER N0.58-04-11 <br />of the <br />City Manager <br />PROPOSED AMENDMENT OF AIRPORT RULE 5.4.4.3(b) AND 7.9.2, AS <br />ADOPTED BY ADMII~TISTRATIVE ORDER NO. 58-03-07-F. <br />The City Manager of the City of Eugene finds that: <br />A. Pursuant to the authority contained in Sections 2.019 and 2.430 of the Eugene Code, <br />1971, the current Rules Governing the Use of Mahlon Sweet Airport ("Airport Rules") were adopted <br />by Administrative Order No. 58-03-07-F of the City Manager on May 9, 2003. <br />B. Section 5.4.4.3 ofthe Airport Rules contains provisions related toself-service fueling <br />facilities, including the minimum and maximum capacities of fuel tanks. Since adoption of this <br />provision the state Fire Code has been amended to allow fuel tanks to exceed the currently <br />established maximum capacity of 12,000 gallons upon approval of the Fire Marshal. Staff has <br />recommended that self-service fueling operators at the Eugene Airport be allowed fuel tanks with <br />a maximum capacity of 15,000 gallons, in order to provide them with the same competitive <br />advantage that is available to operators at other airports. Staffhas also recommended that Section <br />7.9.2 of the Airport Rules be amended to correct references to ASTM standards. <br />~. I concur with the staff recommendations, and find the proposed amendments are <br />necessary in order to ensure that self-service fuel operators at the Eugene Airport enjoy the same <br />competitive advantage as operators at other airports; that the activities are carried on in a safe and <br />equitable manner, and that required standards are correctly referenced. <br />Based on the above fmdings, which are hereby adopted, and pursuant to the authority <br />contained in Sections 2.019 and 2.430 of the Eugene Code, 1971, I hereby propose to: <br />1. Amend Section 5.4.4.3 (b) of the Rules Governing the Use of Mahlon Sweet Airport <br />to provide as follows: <br />5.4.4.3 Self-Service Fueling Facilities. Plans and specifications for the <br />construction and installation ofself-service fueling facilities, including all proposed <br />fuel dispensing and storage equipment, shall be approved by the Airport Manager <br />prior to installation, subject to the requirements of these Airport Rules, the following <br />special requirements and conditions of the operating permit: <br />Administrative Order - 1 <br />~' <br />
