The appeal of the Administrative <br />Order is denied. <br />Findings <br />1. Stewart Road runs east and west between Bailey Hill Road and Bertlesen Road. <br />Stewart Road is approximately seven tenths of a mile long. Stewart Road is one <br />block north of West 1 lth Avenue. There are no intersecting streets joining Stewart <br />Road between Bailey Hill Road and Bertlesen Road. There is a traffic signal at West <br />11~' and Bailey Hill Road and another traffic signal at West 11`h and Bertlesen Road. <br />2. Many travelers who intend to travel west avoid the heavier traffic and frequency of <br />signals along West 11`t' by traveling from 6`h Avenue on to West 5`h to Bailey Hill <br />Road and then to West 11`h. Some of these travelers would turn on to Stewart Road <br />to avoid the signal at Bailey Hill and West 11`h <br />3. Stewart Road was constructed as an oil mat road over the native material in place. <br />The unreconstructed portion of Stewart Road is approximately 20 feet wide and 1,450 <br />feet long. In 1980 the City of Eugene completed improvements to the western 2,300 <br />feet. The improved portion of Stewart Road is 44 feet wide. <br />4. The eastern portion of Stewart Road begins with a repaved portion rising above <br />Bailey Hill Road. Although repaved at some time more recently than the rest of the <br />eastern portion of Bailey Hill Road, this portion of the road has developed a large <br />pothole in the south lane. Stewart Road in its eastern portion climbs up a small hill <br />several hundred feet from Bailey Hill Road, and then descends to Bertlesen Road. <br />
