In addition, the permittee shall be responsible for. promptly removing and cleaning al( <br />excess earth,- stone, crushed rock, rubbish, debris and any unused material that result <br />from work performed. As work progresses, a!i public ways shall be thoroughly cleaned of <br />all rubbish, excess earth, rock, and other debris resulting from such work. All cleanup <br />shall be at the expense of the permittee. Upon failure to do so, wi#hin 48 hours of <br />notification, the City may perform the work and charge the cost thereof to the permittee. If, <br />in the judgment of the Maintenance Planning Manager, a hazardous or dangerous <br />condition exists that affects the public health, safety and welfare, the notification require- <br />ment may be waived and the City may take necessary corrective action to remove the <br />hazardous conditions and charge the costs thereof to the responsible party without prior <br />notification: EC 7.307 (2) <br />Upon completion of the proposed work, the work site and all disturbed landscaping shall <br />be restored to a condition as near as possible to that which existed immediately prior to <br />the work. <br />3.J DAMAGE TO EXISTING FACILtTtES <br />The permittee shall be responsible for all damage to public or private property resulting <br />from the permittee's #ailure to properly protect property while carrying out. the work.. EC <br />7.297 {2) <br />The Utility Inspector and the owner of any damaged facility must be immediately .notified of <br />damage to public or private facilities caused or found by the permittee. When private <br />sewer lines are damaged the permittee shall immediately notify the City Building Sewer <br />Inspector of the Public Works Maintenance Planning Section (682-4800). Required <br />repairs shall meet the~State of Oregon Plumbing Specialty Code and be inspected by the <br />Building Sewer Inspector: The Balding Sewer lnspector shall make note, on the City's <br />sewer connectiori records, of the damage and of the permittee responsible for the <br />damage. . <br />The permittee shall exercise care to avoid disturbing or destroying survey monuments. <br />Survey monuments. disturbed by the permittee's work shall be restored in conformance <br />with requirements of ORS 209.150. <br />3.J.1 Damage to Cif Facilities <br />A permittee who causes damage to a City facility during work activities due to the <br />permittee's failure to follow requirements of OAR 952-001-0010 through 952-001-0090 or <br />failure to use reasonable care to protect City facilities. shall be responsible for all costs of <br />repair or restoration of the facility. When a City facility is damaged the permittee shall <br />immediately notify the Utility inspector. The Utility lnspector shall submit a damage report <br />and a subsequent repair inspection report to the Maintenance Planning Manager. To aid <br />in the updating of the infrastructure condition records, the damage repair report shall <br />include a measured loca#ion and description of the damage and, repair. <br />~-, <br />Utility & f2JW Pefmit Policy 25 - 12/01/97 <br />
