area to be impacted, demonstrates how impacts to those functions are minimized, and <br />demonstrates that the proposal will not result in a net loss of these functions due to <br />the proposed activity; <br />(2) The mitigation plan includes a map showing the location and area of <br />proposed mitigation, along with supporting cross-section, elevations, and diagrams <br />of the finished grade and proposed plantings (species, number, location), and a plan <br />for monitoring and ensuring the success of the mitigation plan that includes suitable <br />financial guarantee to pay for unanticipated construction impacts and to assure <br />mitigation is completed, and documents that guarantee long-term protection of <br />mitigation sites (i.e., recorded easements and restrictive covenants). <br />(3) Analysis. and supporting documentation shall be provided by an <br />Oregon-certified professional engineer (for providing analysis and documentation <br />concerning drainage and flood control), and/or an environmental professional (for <br />providing analysis and documentation about riparian and wetland areas, wildlife <br />habitat, filtering and settling pollutants, or preventing erosion). Environmental <br />professionals shall demonstrate experience with natural stream systems and habitat <br />restoration. <br />(4) If it is not possible to mitigate, for negative impacts to the waterway <br />on the same site, an applicant may propose to mitigate on a nearby site within the <br />;- same waterway corridor as the impacts, or may make a payment to the mitigation <br />.fund at the rates and in the manner described in R-6.650-J. <br />(c) The City Manager may accept a hearings off cial's determination about <br />mitigation where that determination was rendered in connection with a land use process in <br />which the hearings official examined issues and heard evidence similar to what would arise <br />under the mitigation criteria specified in subparagraph (b) above. <br />2. Section R-6.650-F-2(c) of Open Waterways Temporary Administrative Rule R-6.650 <br />is hereby amended to provide: <br />R-6.650-F Open Waterways -Uses or Activities in an Open Waterway (EC 6.660(211. <br />2. Criteria for Approval. The City Manager shall approve, approve with conditions, <br />or deny an application that has been determined to be complete based on compliance with the <br />following criteria: <br />(c) An acceptable plan that meets the criteria of R-6.650-E-2(b) or R-6.650-E- <br />2(c) shows how the property owner will mitigate for the loss of open waterway hydrological, <br />ecological, and water quality treatment functions. <br />AdmlmStratlVe OTdeT - 2 C:\WINDOWS\TEMP\AdminRuleRevisionToTemp.wpd 8/3/00 <br />
