ADMINISTRATIVE ORDER N0.58=00-22 <br />of the <br />City Manager of the City of Eugene <br />AMENDING OPEN WATERWAY <br />TEMPORARY ADMINISTRATIVE RULE R-6.650. <br />The City Manager of the City of Eugene finds that: <br />A. Pursuant to the provisions of Sections 2.019(5) and 6.650 through 6.679 of the <br />Eugene Code, 1971, the City Manager issued Administrative Order No. 5~=00-15 on June 9, 2000 <br />adopting Open Waterway Temporary Administrative Rule R-6.650.. <br />B. Staff has recommended revisions to R-.6.650-E and R-6.650-I to address the effect <br />of determinations of compliance with mitigation requirements made. by hearings officials in <br />connection with land use decisions, and to correct a reference error. The proposed revision to R- <br />6.650-E also necessitates revisions to R-6.650-F-2(c) and R-6.650-G-2(e). I concur with those <br />recommendations, and adoption of this amendment to the temporary rule is specifically authorized <br />by Section 2.019(5) of the Eugene Code, 1971. <br />Now, therefore, based on the above findings, which are hereby adopted, and pursuant to the <br />authority of Sections 2.019(5) and 6.665(3) of the Eugene Code; 1971, <br />The City Manager of the City of Eugene Orders that: <br />1. Section R-6.650-E-2 of Open Waterways Temporary Administrative Rule R-6.65,0 <br />is hereby amended to proeide: <br />R-6.650-E Open Waterways -Prior Approved Filling-Piping Plan Review (EC 6.660(11. <br />2. Criteria for Approval. The City Manager shall approve, approve with conditions,. <br />or deny an application that has been determined to be complete based on compliance with -the <br />following criteria: <br />(a) The applicant has provided evidence that the piping or filling was specifically <br />authorized by an approval that was final at the local level prior to May 24, 2000; <br />(b) The proposed plan meets the following mitigation requirements: <br />(1) The applicant's mitigation plan includes a description of existing <br />waterway hydrological, ecological, and water quality treatment functions within the <br />AdmlmstratlVe Order - 1 C:\WINDOWS\TEMP\AdminRuleRevisionToTemp.wpd 8/3/00 <br />
