ADMINISTRATIVE ORDER NO. 58-98-10 <br />of the <br />City Manager Pro Tem of the City of Eugene <br />CONCERNING NOTICE OF INTENDED AMENDMENT OF MWMC <br />PROVISIONS OF SYSTEMS DEVELOPMENT CHARGE METHODOLOGY <br />The City Manager Pro Tem of the City of Eugene finds as follows: <br />A. Sections 2.020 and 7.705 of the Eugene, Code, 1971 authorize the City Manager of the <br />City of Eugene to determine and set fees and charges to be imposed by the City for services, goods, use <br />of municipal property, and licenses and permits, and specifically systems development charges. Section <br />7.710 of the Eugene Code, 1971 further authorizes the City Manager to adopt and/or amend by <br />administrative order, the methodologies used for establishing the systems development charges, and <br />provides this may be effected concurrent with the establishment or revision of a systems development <br />charge. <br />B. In accordance with the procedures set forth therein, I intend to amend the Systems <br />Development Charge Methodology relating to the Metropolitan Wastewater Management Commission <br />(MWMC) by increasing fees for the Regiorial Wastewater Systems Development charge, eliminating the <br />shopping center category from the rate table as this type of establishment is more accurately described by <br />other categories in the table, and updating the MWMC credit table. MWMC has completed an annual <br />update of the value of its assets, the value of proposed future improvements, and the value of prior property <br />tax payment contributions for existing vacant land. These changes are the basis for the proposed increase <br />in the MWMC SDC rates. <br />C. I fmd that the revisions to the Systems Development Charge Methodology and the fees as <br />set forth in Exhibit A (Table 1-page 3, Table 5- page D-9, Attachment 3-page D-10, Attachment 4-page <br />D-11, Calculations-page G-4, and Section 2.3-page G-6) hereto are consistent with adopted policies and <br />ordinances of the City, in conformity with applicable state law, and should be implemented effective July <br />1, 1998. Those portions of the Systems Development Charge Methodologies adopted by Administrative <br />Order No. 58-97-02-F-2 and Administrative Order No. 58-97-07-F, in conflict herewith should be amended <br />as of that effective date. <br />On the .basis of these findings, I order that: <br /> <br />1. Copies of the Notice be provided to the Mayor and City Councilors, published in the <br />Register Guard, a newspaper of general circulation within the City, posted at four public locations, and <br />be made available for interested persons at the offices of the City Manager at 777 Pearl Street, Room 105, <br />the City Public Works Building Lobby, 858 Pearl Street, the Permit and Information Center Lobby, 999 <br />W. 10~` Avenue, and the Eugene Public Library, 100 W. 13"' Avenue, during normal business hours (8:00 <br />a.m. to 5:00 p.m., Monday through Friday, exclusive of holidays, except for the Library). <br />2. All persons desiring o comment thereon shall submit written comments as set forth in the <br />Notice. After consideration of comments received, I will thereafter, by administrative order, establish the <br />fees as proposed or as modified in response to comments. <br />Dated this 19th day of May, 1998. <br />~~ <br />James R.
