Historically, an additional 10-15 claims are filed after the end of the fiscal year. If <br />so, this total would be consistent with the City's five year average of 121 claims filed. The <br />Public Works and Police Departments continue to account for the majority of claims filed <br />with 88 (83%) of the claims charged to those two departments. The total incurred (paid plus <br />reserved) of $294,259 compares very favorably to the City's five year average incurred of <br />$1,018,349 however, the <br />City's five year average <br />incurred remains high due to City of Eugene <br />the settlement of 14 lawsuits resulting from the Five Year History-Incidents/LiabilityGaims/Lawsuits <br />criminal acts of two former police officers. Based soo <br />on the City's recent favorable claim history, we <br />expect the average incurred to continue to drop over zeo <br />the next few years. Of the 106 claims filed against <br />the City in FY07, 77 claims have been closed with a zoo <br />total paid of $146,940. 29 claims remain open. ~ <br />~; tso <br />E <br />The graph on the right sho~fvs a five year Z,oo <br />comparison of the number of incidents of injury or <br />damage reported to Risk Services each year, the so <br />number of liability claims actually filed, and the <br />number of resulting lawsuits. In FY06, the City's o <br />percentage of claims that resulted in a lawsuit was FY03 FY04 FY05 FYOS FY07 <br />1.85% compared to the average of 3.6% for ma~r,rs Liability Claims ~ Lawsuits <br />jurisdictions reporting to ICMA. FY07 numbers are <br />not yet available through ICMA. <br />Equity Suits <br />Risk Services assumes responsibility for claims that are not covered by the City's insurance program but are <br />liabilities to the City arising from legal challenges to City policies, ordinances or citizen initiatives. Three equity <br />suits are currently pending in FY07. One lawsuit was filed in FY03 challenging the fee schedule established by <br />the City for its utility permit program. A petition for review has been filed in the Supreme Court. This past year, <br />two new equity suits were filed; one Measure 37 land use claim and one claim challenging the telecom <br />ordinance.
