A total of $21,716 was paid on ten claims. Five were closed without ^" <br />oavment. <br />The department sustained ten at-fault motor vehicle accidents that involved another <br />vehicle. Five accidents involved sideswiping or damaging a parked vehicle, four involved <br />backing up and one involved rear-ending another party. No injuries were reported in any of <br />the at-fault accidents and a total of $11,517 was paid on eight claims. Two claims were <br />closed without payment. <br />Nine claims were filed against the department resulting from road ~ ~,. <br />conditions; four bicyclists claimed injuries from the condition of the <br />pavement, two claims were filed for damage to vehicles caused by <br />missing catch basin covers, and three claims were filed due to potholes. ,_.~- <br /> <br />Six claims were filed against the City resulting from trips and falls on City ~k'R <br />~` ~ ~ <br />''~+ <br />sidewalks. Five of those claims were tendered to the adjoining property `~'~ <br />~ <br />owners and closed with no payments made. One claim remains open. °~ '~' <br />`'' <br />~~ <br /> ~.,~t <br />• r'7~#r-r <br />. <br />` <br />Three tree limb related claims were also filed in FY07. One falling tree limb damaged two ~ ~. M1 <br />~ <br />vehicles. No injuries were reported and no payments were made. ~~''~~:,r,-3~ ''-~' <br />The remaining four claims resulted from miscellaneous causes including: a rock coming off a City truck; minor <br />damage to a rented facility; an injury to a pedestrian allegedly caused by negligent street design and damage <br />to a vehicle caused by a faulty airport gate. <br />Litigation <br />One new lawsuit was filed in fY07 against the Wastewater Treatment Plant challenging the City's practices as <br />they relate to the Clean Water Act. That case has since been resolved. One inverse condemnation lawsuit <br />charged to both Planning & Development and Public Works remains open and active. With a recent court <br />ruling in the City's favor, we anticipate this lawsuit will be resolved in FY08.
