2.C REVOCABLE PERIVIITS FOR PRIVATE FACILITIES. <br />A revocable permit may be issued to permit placement and operation of private facilities within the <br />public way which is not authorized by an existing franchise or license. As with all right-of--way <br />permits, the City reserves the right to "revoke" or cancel the permittee's permission to use the public <br />way at a later date. This type of permit is typically used for placement of a private structure or <br />facility that serves an individual property, site, or business and is not placed for the provision of <br />services to others. Detailed questions concerning revocable permits should be addressed to the <br />Engineering Division personnel at the Permit and Information Center located at 99 West 10~` <br />Avenue, Eugene, OR 97401. <br />Unless otherwise specified in a license or franchise agreement, or by the issuance of a temporary <br />surfacing permit (TSP), a revocable permit shall be obtained prior to the placement of any private <br />facility upon, over or under the public way. The pennittee shall be required to pay all established <br />permit fees and user fees. A revocable permit, by itself does not allow for construction to be <br />performed or for work to occur in the public way. Issuance of a revocable permit does not relieve <br />the permttee from the obligation to obtain any other required permits. Examples of other <br />permits that may be required are: building, right-of--way cut, tree removal, and wastewater or <br />stormwater connection. Any revocable permit that entails excavation within the public way shall, <br />at a minimum, also require aright-of--way cut permit. <br />Revocable permits that involve the placement of underground facilities shall inform the permiee <br />of the requirement that the permiee subscribe to the Oregon Utility Notification Center and <br />respond to requests from underground excavators for the field location of the permittee's facilities. <br />Failure to maintain this subscription may result in the permit being revoked. <br />Revocable permits shall be subject to conditions specified by the City Engineer or designee. All <br />work in the public way associated with installation or operation of a private facility within the public <br />way shall conform to permitting and work standards included herein including, but not limited to, <br />all standards for temporary traffic control, construction practices, and technical provisions included <br />herein. See EC 7.302. <br />A private facility or structure placed in the public way prior to receiving approval by the City <br />Engineer may result in a requirement to remove the structure or facility. If it becomes necessary for <br />the proper or necessary public use of any public way that any facility installed or constructed be <br />removed or relocated, the City Engineer or designee shall give written notice to the owner of the <br />facility to remove the same within a reasonable time. If the owner fails to comply with such notice, <br />the City may remove or relocate the facililty and charge the costs of removal or relocation to the <br />owner.
