the interest of the City shall not be affected by the operator's <br />breach of the poi icy provisions. <br />6.3.15.3 Worker's Compensation Insurance. The <br />operator sha17 comply. with the Oregon worker's compensation law by <br />quaiifying as a carrier-insured emp]oyer or as a self-insured <br />empioyer and shall strictly comply with all other applicable <br />provisions of such law. The operator shall provide the City with <br />the assurances that the City may require that the operator is in <br />compliance with the worker's compensation law. This rule is not <br />intended to require worker's compensation by an operator for <br />agents, when that coverage is not required by state law. <br />6.3.16 Indemnification. An operator shall indemnify .and hold <br />the City of Eugene and .its officers, agents and employees, harmless from <br />and against all claims, actions, liabilities, costs, including costs of <br />defense, arising out of or in any way related to the operator's activi- <br />ties at the Airport, the operator's failure to comply strictly with any <br />provision of these rules or of the operator's lease or permit with the <br />City, or of any other act-ions or failure to act by the operator and .the <br />operator's employees, agents; officers and contractors. In the event <br />"any such action or claim is brought against the City, the operator <br />shall, if the City so elects and upon tender by the City, defend the <br />same at the operator's sole expense and cost, promptly satisfy any <br />:judgment adverse to the City or to City and operator jointly, and` <br />reimburse the City for any loss, cost, damage or expense suffered or <br />incurred by the City, including any legal. fees, or fines paid to the FAA <br />or any other governmental agency arising from the operator's activities. <br />6.3.17 Vending Machines. An operator .shall not install or <br />operate. vending machines, ;pay telephones,.coin-operated amusement <br />,; machines or devices in or upon any leased premises, except as approved <br />ey c,ty: City specifically reserves the right to arrange for the <br />`'installation of such machines or devices and such other concessions as <br />~' the City may desire. <br />6.3.18 National Emergencies.. During time of war.. or national <br />emergency, .the City shall have the-right to lease the Airport, or any <br />part of the Airport to the United States for military use. Any permit, <br />lease, or authority granted under these rules shall be subject to and <br />controlled, in the event of inconsistency, by that government lease. <br />,. - . <br />6.3.19 Existing and Future Government Agreements. Any <br />permit, lease, or agreement entered into under these rules shall be <br />'subject to the terms the sponsor's assurances and agreements now <br />required or imposed in the future between the City and the FAA or its <br />successor, any existing or future agreement between the City of Eugene <br />and the United States, and to any directive from the fAA or its <br />successor to the City, relative to the operation or the maintenance <br />of the Airport or the obtaining of federal .grants. <br />Rules - 26 <br />
