Covers State and Local Governmental Agencies <br /> 3. Purpose was to create a uniform basis for labor relations -improve <br /> <br /> ' empioyerJemployee relations, minimize court actions, both in the public interest <br /> 4. Modeled after NLRA, though more liberal towards unions in some areas <br /> 5. Lobbied for by the Education Association; strongly Democratic Legislature <br /> 6. Successful in achieving goal -few legislative changes in twenty years, accepted body <br /> of case law; only three Employment Relations Boards (ERB) in twenty years <br /> 7. First change to Act was in 1995 - Senate Bi11750 -Republican Legislature <br /> a. Very controversial bill; took governor's intervention to pass <br /> b. Changes addressed decisions made by ERB and courts in recent years <br /> c. Forms ERB to promulgate administrative rules and enforce the law; calls for one <br /> management rep, one union rep, and one neutral. <br /> 2. Establishes right of public employees to form, join, and participate in a labor <br /> organization of their own choosing for purposes of representation and collective <br /> bargaining over matters of employment relations. <br /> 3. Excludes supervisors and managers (state only) and employees involved in collective <br /> bargaining (confidential employees) from unions. <br /> 4. Defines methods for joining unions and appropriate bargaining units <br /> - defines Fair Share <br /> - considers community of interest for units <br /> - enumerates certain groups that can't be in same union (e.g., certified teachers <br /> and classified staff) <br /> - defines timing and process for elections <br /> _ <br /> <br />
