her/his absence. Supervisors may approve leave without pay of up to five (5) <br /> working days. Leave requests beyond five (5) days must be in writing and <br /> must establish reasonable justification for approval by the City. The requests <br /> must be submitted to the City to allow reasonable time for review. Response <br /> <br /> ~ to a request should be given to allow an employee adequate notice of its <br /> I <br /> disposition prior to the period for which the leave of absence is being <br /> requested. Union representation leave as provided in Article 7 shall be <br /> ~ considered reasonable justification. Family medical or parental leave will be <br /> considered reasonable justification for approval of requests for leave without <br /> ~ pay which, notwithstanding any other provision of this Agreement, shall be <br /> granted as required by law. <br /> ~ 32.2 Employees on leave without pay for one (1) calendar month or more will not <br /> be eligible for any insurance benefits provided under the terms of this <br /> Agreement, except as required by FMLA. Except for military leave and <br /> workers' compensation leave, employees' credited years of service and <br /> seniority dates will be adjusted to reflect a deduction of the time of a leave <br /> without pay. <br /> i <br /> 32.3 Employees on an approved leave of absence may purchase City health insur- <br /> ance at their own expense. The City may establish procedures for this <br /> purchase. Employees on family medical or parental leave shall continue to <br /> have health insurance benefits aid as rovided in state and federal law. <br /> p p <br /> 32.4 Except for Union representation leaves as provided in Article 7, sick leave as <br /> specified in Article 26, and Family Medical and Parental Leave as specified in <br /> Article 27, employees are generally required to use accrued vacation, holiday <br /> and compensatory time prior to going on leave without pay. <br /> 32.5 In the event an employee going on leave without pay requests to save some <br /> paid leave time, the request must be made in writing and must specify the <br /> reason for saving paid leave. If the request is denied, the denial shall be in <br /> writing. <br /> Article 33 <br /> PERSONNEL RECORDS <br /> 33.1 The City shall maintain records .relative to each employee's performance, <br /> including: promotion, disciplinary actions, complaints or other matters relative <br /> to the status of an employee. The records shall be collectively referred to as <br /> the Personnel file. <br /> 33.2 Personnel files of all employees shall be treated in accordance with Oregon's <br /> Public Records law. Access to the Personnel files shall be limited to <br /> AFSCME contract - 47 - <br /> <br />
