Section 11. Special Campus Concerns <br />~ 11.1 Campus Security. City and District recognize and support modest and safe use of 4J <br />fields by neighbors and the community during the instructional day as long as the use does not disrupt <br />the operation of school or the instructional program. City and District agree to the following: <br />(1) The facilities described in Section 1 of this Agreement that are located on <br />District property will be used in a fashion that maximizes community use. However, such use <br />must be compatible with protecting the safety and security of students, staff, and visitors. <br />District reserves the right to control use and access to the facilities during the instructional day <br />from 7 a.m. to 4 p.m and to post signage to such effect. <br />(2) District reserves the right to restrict partial or all use for up to 48 hours to <br />respond to a safety or welfare emergency. The Superintendent or designee will inform the City <br />Manager or designee of such a decision. Any restriction that extends beyond 48 hours requires <br />the concurrence of the City Manager or designee. <br />(3) District agrees to adopt City of Eugene Park & Open Space Rules for Parks <br />Premises (Section 1.2) and allow for rules enforcement by the City of Eugene Police Department. <br />The City will post Park & Open Space Rules signs at these facilities. Wherever there is a conflict <br />between this Agreement and Park & Open Space Rules, this Agreement shall govern, except as <br />City and District officials shall mutually agree. <br />11.2 Dogs. Dogs, with the exception of service dogs, will not be permitted inside the stadium <br />fences at the artificial surface fields. Dogs on leashes may be brought into other areas of the Youth <br />Sports Parks provided that they do not disrupt the educational program, are not a physical or sound <br />nuisance or danger, and provided that the owners clean up dog litter. <br />11.3 Parking During the Instructional Day. Members of the community arriving by car to use <br />the facilities during the instructional day may not park in the school lots without prior approval of the <br />school administrator. <br />Section 12. Termination <br />12.1 Procedure for Termination <br />Neither party may terminate this Agreement for a breach by the other party without first <br />providing the other party written notice of the specific nature of the alleged breach and a reasonable <br />opportunity to cure the breach. A reasonable opportunity to cure the breach shall be 30 days or such <br />other lesser or greater time as is appropriate given the nature of the breach and the time necessary to <br />cure it. <br />12.2 Remedies for Termination <br />Notwithstanding any other provision herein, each party reserves the right to terminate this <br />Agreement by written notice. Such termination shall be effective one yea~ after notice is given. If District <br />terminates this Agreement, for any reason other than City's breach of this Agreement, or if City <br />terminates this Agreement because District breaches this Agreement, District shall reimburse or in some <br />Amended and Restated Intergovernmental Agreement 2008-01033: Joint Use and Development of Youth Sports Parks and Athletic Fields <br />Page 8 of 11 July i; 2008 <br />
