(b) Base Asphalt Cement Material Price (Base) -The Base price for this Project is the <br />MACMP published on the ODOT website for the month immediately preceding the bid <br />opening date. <br />(c) Monthly Asphalt Cement Adjustment Factor -The Monthly Asphalt Cement <br />Adjustment Factor will be determined each month as follows: <br />• If the MACMP is within ± 10% of the Base, there will be no adjustment. <br />• If the MACMP is more than 110% of the Base, then: <br />Adjustment Factor (%) _((MACMP)/(Base)) x (100) - 10 <br />• If the MACMP is less than 90% of the Base, then: <br />Adjustment Factor (%) _((MACMP)/(Base)) x (100) + 10 <br />(d) Asphalt Cement Price Adjustment - An asphalt cement escalation/de-escalation <br />clause will be in effect during the life of the Contract. A price adjustment will be made for <br />each pay item in the bid schedule containing asphalt cement. The price adjustment as <br />calculated in 00195.10(c) above will use the MACMP for the month the asphalt is <br />incorporated into the Project. The price adjustment per a ton of HMAC incorporated that <br />month will be the difference between the cost submitted by the Contractor in the bid <br />schedule for "Asphalt Cement in HMAC Per Ton of HMAC Complete" and the adjusted <br />cost found by multiplying the "Asphalt Cement in HMAC Per Ton Of HMAC Complete" by <br />the Adjustment Factor. The Agency reserves all of its rights under the Contract, <br />including, but not limited to, its rights for suspension of the Work under 00180.70 and its <br />rights for termination of the Contract under 00180.90, and this escalation/de-escalation <br />provision shall not limit those rights. <br />00220.02 Public Safety and Convenience <br />(Add) Unless otherwise shown on street specific approved traffic control plans, the Contractor <br />shall maintain a minimum of one lane open in each direction for two way traffic during <br />approved work hours. Full road width shall be open weekends, holidays and other days <br />not scheduled for work. <br />00220.40(e) Lane Restrictions <br />(Add) To the beginning of the second bullet: <br />North Game Farm Road is a Minor Arterial street. <br />(Add) To the second bullet: <br />In addition, do not close any traffic lanes between: <br />• 3:00 p.m. on Fridays and midnight on Sundays. <br />• Noon on the day preceding legal holidays or holiday weekends and midnight on legal <br />holidays or the last day of holiday weekends. <br />Special Provisions -Job #4376 Page 7 <br />
