specifications, unless otherwise specified in the Contract, and will be warranted <br />for the remaining Warranty period. <br />Warranty work shall be performed when weather permits. If, in the opinion of the <br />Engineer, immediate repairs are necessary and the repairs cannot be delayed <br />until the Manufacturer can perform them, temporary repairs will be made by the <br />Agency or an independent contractor at the Manufacturer's expense. The <br />Manufacturer shall replace all temporary repairs with permanent repairs at no <br />additional cost to the Agency. <br />The Manufacturer shall provide all required traffic control during repair or <br />replacement of defective Work at no additional cost to the Agency. <br />(2) Trade Practice Guarantees -For those Items of Work installed on the <br />Project that have customary trade practice guarantees, the Contractor shall <br />furnish the guarantees to the Engineer at the completion of the Contract. <br />00180.41 Project Work Schedules <br />(Add) A Type A schedule as detailed in the specifications is required on this Contract. <br />00180.50(h) Contract Time <br />(Add) Complete all Work to be done under the Contract, except for illumination and seeding <br />establishment, not later than October 8, 2008. Complete all Work to be done under the <br />Contract, except seeing establishment, not later than November 14, 2008. <br />00180.85(b) Liquidated Damages <br />(Add) The liquidated damages for failure to complete the Work on time are $700.00 per <br />Calendar Day *. <br />* Calendar Day amounts are applicable when the Contract time is expressed on the <br />Calendar Day or fixed date basis. <br />00195.10 Payment for Changes in Material Costs <br />(Add) (a) Monthly Asphalt Cement Material Price (MACMP) -The Monthly Asphalt Cement <br />Material Price (MACMP) will be established by ODOT each month. For information <br />regarding the calculation of the MACMP, and for the actual MACMP, go to the ODOT <br />website at: <br />http://www.oregon.gov/ODOT/HWY/ESTIMATING/asphalt_fuel.shtm <br />If the ODOT selected index ceases to be available for any reason, the Agency in its <br />discretion will select and begin using a substitute price source or index to establish the <br />MACMP each month. The MACMP will apply to all asphalt cement including but not <br />limited to paving grade, polymer modified, and emulsified asphalts, and recycling agents. <br />The Agency does not guarantee that asphalt cement will be available at the MACMP. <br />Special Provisions -Job #4376 Page 6 <br />
