<br /> i i?~' . <br /> <br /> . _ ; <br /> i <br /> ADMINISTRATIVE ORDER NO. 8 - ~S-o Z <br /> ~rrr ~ of the <br /> City Manager of the City of Eugene <br /> PROP SED ADMINISTRATIVE RULE R-6.451 ADOPTING <br /> AME MENTS TO THE STORMWATER SERVICE METHODOLOGY. <br /> The Ci Manager of the City of Eugene finds that: <br /> A. n November 17, 1993 the City Council adopted Ordinance No. 19939 <br /> regarding was ewater and stormwater systems and adopting the stormwater Service Charge <br /> Methodology aper ("Methodology"). That Ordinance, and Section 6.451 of the Eugene <br /> Code, 1971 as adopted therein, provided that the future modifications of the Methodology <br /> would be effe ted by the City Manager. <br /> B. ubsequently, on September 28, 1994, Ordinance No. 19984 was passed by the <br /> City Council nd approved by the Mayor adopting changes to the monthly stormwater <br /> customer cha es, separating out components rel,3ted to roads. <br /> C. amended by Ordinance No. 19984, the monthly stormwater customer <br /> charge is no composed of (1) a water quality and quantity component; (2) an <br /> _ administrative component; and (3) a road component. It was intended that reductions and <br /> exemptions co tinue to be available for water quality and quantity components for property, <br /> but not for th road component. <br /> D. a rate methodology set forth in Exhibit A to Ordinance No. 19984, which <br /> provides for mplete reductions or exemptions, was amended by an Emergency Rule <br /> adopted by A ministrative Order No. 58-94-27 of the City Manager, effective November 1, <br /> 1994 to clarify hat the exemption applies to water quality and quantity components, but not <br /> to the road or administrative component. <br /> E. hat Emergency Rule will expire on April 30, 1995, and the City Manager <br /> intends to ado t as a permanent rule proposed changes to the Methodology which clarify <br /> that exemptio s or reductions provided for therein do not apply to road or administrative <br /> components o the stormwaterctharges, and to effect minor editorial changes to create <br /> consistent usa a of terms throughout the Methodology, all as more particularly set forth in <br /> Schedule 1 to ibit A hereto. These proposed revisions implement the action taken by <br /> the Council, d stormwater customers will be able to reduce monthly charges for the <br /> quantity and q ality components of the charge, but no exemptions will be granted for the <br /> street-related nd administrative components of the charge. <br /> F. ailure to act promptly in adopting the proposed revisions prior to expiration <br /> of the Emerg ncy Rule adopted by Administrative Order No. 58-94-27 will prejudice the <br /> dministrative Order - 1 <br /> <br />
