i <br /> s <br /> 7.13 In calculating the credits given under this section the City Manager or <br /> the Manager's designee shall estimate the cost of the capital <br /> improvement based upon what the city would pay were it to construct <br /> such improvements. <br /> I' <br /> ~ 7.1.4 The credit given under this section may be applied against both the <br /> <br /> - ~ ~ reimbursement fee and improvement charge components of the SDC <br /> j for the type of capital improvement being constructed. <br /> 7.1.5 If a capital improvement for which a credit has been given is not <br /> constructed or the ro ram not im lemented within the time re uired <br /> P g P q <br /> b these Methodolo ies the credit ma be revoked and the un aid <br /> Y g ~ Y P <br /> portion of the SDC reimposed. Such revocation shall not occur until <br /> ten days prior written notice has been given to and an opportunity to <br /> be heard afforded the permittee and property owner. If the credit is <br /> 'revoked, the City Manager or the Manager's designee may add to the <br /> amount due, the cost of the revocation proceedings. <br /> 7.1.6 When an equivalent assessment or a special benefit assessment is <br /> collected because new development connects to a local improvement <br /> for which the City has granted a credit under (2) above, the revenue <br /> collected (net of the costs of collection) shall be deposited in the SDC <br /> fund for the s stem to which connection was made and for which the <br /> Y <br /> i <br /> credit was given. <br /> 7.2 A lication for Credit <br /> PP <br /> i <br /> ~ An application for a credit and related information shall be submitted by the <br /> applicant in the manlier prescribed by the City, together with the fee set by the city <br /> ~ manager pursuant to E.C. 2.020. The applicant shall have the burden of <br /> demonstratin the ell bill for a credit with clear and convincin evidence. No <br /> g Z~ tY g <br /> variance or credit shall be granted for an SDC that has already been imposed, <br /> collected or agreed to be paid in installments. <br /> I <br /> 73 Decision on A lication for Credit <br /> PP <br /> The City Manager or the Manager's designee shall approve, conditionally approve, <br /> or deny an application in writing setting forth the reason for the decision. Such a <br /> !i decision shall be mailed or personally delivered to the applicant. <br /> $.0 Appeals <br /> appeal by an applicant or a permittee of any decision of the City Manager or the <br /> 1~Ianager's designee under these Methodologies shall be governed by EC 7.735 and must be <br /> ed and the appeal fee paid within 15 working days of the date of the decision.
