The applicant of a denied permit shall have the right of appeal to the City Manager. See <br /> section 2.021 of the Eugene Code for appeal procedures. EC 7.295 <br /> Except as outlined below in the section titled "Emergency Permits", permits shall not be <br /> issued "after the fact" for work performed without prior approval of the Utility Inspector. <br /> Permit fees for individual right-of--way cut permits shall be paid upon issuance of the <br /> permit unless the applicant has previously made arrangements to be billed by the City. <br /> Permit fees will be calculated by the City staff issuing the permit upon approval of the <br /> permit utilizing the fee schedule as set by administrative order of the City Manager. <br /> Because permit review and inspection activities can be more efficient for joint trench <br /> installations involving multiple utilities in a common trench, a matrix of graduated permit <br /> fees is included in the fee schedule. Using the permit fee matrix, the Utility Inspector shall <br /> determine the individual permit fee which most appropriately reflects the characteristics of <br /> the proposed work. <br /> 2.D.4 Expiration <br /> Right-of-way cut permits shall be valid for a period not to exceed six months from the date <br /> of issue. Work may not be performed under an expired permit. Permit renewals shall <br /> follow the same process as that used for a new permit. <br /> 2.E EMERGENCY PERMITS <br /> <br /> A permit (i.e. Right=of-Way Cut, Public Improvement, Revocable) is required for all work <br /> within the public way. However, when emergency repairs of an existing facility are <br /> necessary, work may commence prior to the application for a permit. If this emergency <br /> occurs during the normal working hours of the Maintenance Division, immediate verbal <br /> notice to the Utility Inspector, Maintenance Planning Manager or Maintenance Support <br /> Manager is required. <br /> In the case where emergency repairs are necessary outside the normal business hours of <br /> the Maintenance Division, the Eugene Police Department (682-5111) should be notified if <br /> the work is within a street or alley and will necessitate a lane closure. If a representative <br /> of the Public Works Department is needed, upon request of the permittee, the Eugene <br /> Police Department will notify the "on-call" supervisor of the Maintenance Division. For <br /> emergency repairs which are likely to impact street trees, the Public Works Department <br /> must be notified and the Urban Forester consulted to determine impacts to public trees. <br /> Application for an emergency permit shall be submitted no later than the next working day <br /> following the emergency repairs.
