work progresses, all public ways shall be thoroughly cleaned of all rubbish, excess earth, rock, and <br /> other debris resulting from such work. All cleanup shall be at the expense of the permittee. Upon <br /> failure to do so, within 24 hours of notification, the City may perform the work and charge the cost <br /> thereof to the permittee. If, in the judgment of the Utility Permit and Inspections Supervisor, a <br /> hazardous or dangerous condition exists that affects the public health, safety and welfare, the <br /> notification requirement may be waived and the City may take necessary corrective action to remove <br /> the hazardous conditions and charge the costs thereof to the responsible .party without prior <br /> notification. EC 7.307 (2) <br /> Upon completion of the proposed work, the work site and all disturbed landscaping shall be restored <br /> to a condition as near as possible to that which existed immediately prior to the work. <br /> 3.J DAMAGE TO EXISTING FACILITIES <br /> The permittee shall be responsible for all damage to public or private property resulting from the <br /> permittee's failure to properly protect property while carrying out the work. EC 7.297 (2) <br /> The Inspector and the owner of any damaged facility must be immediately notified of damage to <br /> public or private facilities caused or found by the permittee. When private wastewater or stormwater <br /> lines are damaged the permittee shall immediately notify the City Building Wastewater Inspector of <br /> <br /> the Public Works Maintenance Planning Section (682-4800). Required repairs shall meet the State <br /> of Oregon Plumbing Specialty Code and be inspected by the Building Wastewater Inspector. The <br /> Building Wastewater Inspector shall make note, on the City's wastewater or stormwater connection <br /> records, of the damage and of the permittee responsible for the damage. <br /> The permittee shall exercise care to avoid disturbing or destroying survey monuments. Survey <br /> monuments disturbed by the permittee's work shall be restored in conformance with requirements <br /> of ORS 209.150. <br /> <br /> No Temporary Surface Permit (TSP) will be issued without the applicant providing a written <br /> statement which acknowledges that the maintenance of the facility and the liability of any damage <br /> from drainage problems associated with the facility are the applicants private responsibility. <br /> No Temporary Surface Permit (TSP) permit will be issued which requires any work to be performed <br /> on private property, without a written statement granting the permission from the owner of record. <br /> 3.J.1 Damage to City Facilities <br /> A permittee who causes damage to a City facility during work activities due to the permittee's failure <br /> to follow requirements of OAR 952-001-0010 through 952-001-0090 or failure to use reasonable <br /> care to protect City facilities shall be responsible for all costs of repair or restoration of the facility. <br /> Utility & R/W Permit Policy <br /> Exhibit A - 34 r.\adminord\rules\OOrowrlexa.wpd(09/13/00) <br /> <br />
