CITY OF EUGENE <br /> Department of Public Works <br /> Policies and Procedures <br /> Utility and Right-of--Way Permits <br /> Construction Within and Use of the Public Way <br /> Section 1: GENERAL <br /> The provision herein shall go into effect September 27, 2000. <br /> 1.A AUT ORITY <br /> This operatio 1 policy and procedure document was prepared and enacted under the administrative <br /> and rule-maki g authority granted the City Manager by Section 2.019 of the Eugene Code, 1971 and <br /> the authority ranted the City Engineer by Section 7.007 of the Eugene Code, 1971. <br /> 1.B INT ODUCTION <br /> Street rights-o -way and public utility easements (PUE) are part of the public way and intended for <br /> the use of all citizens for vehicular and pedestrian movement, access to private property and the <br /> delivery of es ential utility, fire, police, and transportation services. Section 7.007 of the Eugene <br /> Code, 1971 c arges the City Engineer with the responsibility of protecting the public's rights within <br /> the public w y for these purposes. That responsibility is discharged in part by controlling <br /> construction d special uses of the public way through the issuance of permits. Section 7.302 of <br /> the Eugene ode, 1971 specifies that the City Manager issue administrative rules related to <br /> construction ithin and use of the public way. This manual has been adopted as a part of <br /> Administrati Rule R-7.302 under the rule-making authority granted the City Manager. <br /> The primary c ncern when exercising this authority is to prevent personal injury, property damage <br /> and inconveni nce to the public resulting from improper construction practices and right-of--way uses <br /> by contractor public utilities, public agencies, and property owners.
