~ ' J 1L J( <br /> ~j' L~ <br /> ADMINISTRATIVE ORDER NO. 58-02-25 <br /> of the <br /> <br /> r City Manager pro tem of the City of Eugene <br /> I <br /> PROPOSED ADOPTION OF STANDARDS FOR GEOLOGICAL AND <br /> GEOTECIINICAL ANALYSIS ADMINISTRATIVE RULE R-9.6710. <br /> Ik <br /> The City Manager pro tem of the City of Eugene finds as follows: <br /> A. Section 2.019 of the Eugene Code, 1971(EC) authorizes the City Manager to adopt <br /> ~ 'rules for administration and implementation of any provisions of that Code. Some provisions of EC <br /> Chapter 9 that became effective on June 1, 2002 require the submission of a geological and <br /> g~otechnical analysis. The analysis is intended to ensure that public and private facilities in <br /> d$velopments in areas of known or potential unstable soil conditions aze located, designed and <br /> cgnsttucted in a manner that provides for the public health, safety and welfare. Those EC provisions <br /> sdt forth the categories and applicability of three different categories of geological and geotechnical <br /> ~ analysis; and provide for specific exemptions. <br /> B. EC 9.6710(2) provides that geological and geotechnical analyses shall be prepared <br /> iii a manner that conforms to the standards, procedures and content in the Standards for Geological <br /> aiad Geotechnical Analysis adopted by the City Manager in the manner provided in EC 2.019. <br /> C. ~ City staff has worked with the development community for several months in <br /> d$veloping the Standazds for Geological and Geotechmcal Analysis contained herein, and has <br /> recommended its adoption. I concur with that recommendation and find that adoption of the <br /> ~ Standazds for Geological and Geotechnical Analysis Administrative Rule R-9.6710 as hereinafter <br /> (set forth is necessary in order to provide direction ui meeting the requirements of the Eugene Code, <br /> j 171. <br /> 4 <br /> Based on the above findings, I hereby propose to adopt the following: <br /> STANDARDS FOR GEOLOGICAL AND GEOTECIINICAL ANALYSIS <br /> ADMINISTRATIVE RULE R-9.6710 <br /> i <br /> 1 <br /> R-9.6710-A Definitions. <br /> As used in this Rule, the following words and phrases are defined as follows: <br /> Complex Project: A development proposal that is required to be approved through <br /> a site review, conditional use permit, planned umt development, subdivision or partition, <br /> and/or is located in an area having any of the following'geographic constraints: (a) slopes <br /> greater than ten (10) percent; (b) wetlands or springs; (c) expansive soils; (d) seismic nsk; <br /> or (e) previous land use activities that negatively impact the stability of the site. <br /> ~ Design Area: Soil azeas within the development site with material and groundwater <br /> characteristics similaz in both physical properties and vertical and horizontal distribution. <br /> Engineering design and construction capabilities and constraints aze the same throughout a <br /> ~ design area and may be randomly distributed throughout the development site. <br /> Administrative Order - 1 <br /> r.\~dminordlrules\02geotechlao.wpd(09/05~2) <br /> <br />
