ADMINISTRATIVE ORDER N0.58-06-03-F of the City Manager of the City of Eugene AMENDMENT OF STORMWATER USER FEE SCHEDULE AND REPEAL OF ADMINISTRATIVE ORDER N0.58-OS-03-F. I' The City Manager of the City of Eugene finds as follows: . A. Section 6.411 of the Eugene Code, 1971 (EC), authorizes the City Manager to determine and set fees and charges to be imposed by the City for wastewater service, regional wastewater service, and stormwater service. B. In accordance with the procedures of EC 6.411, I issued Administrative Order No. 58- 06-03 on April 21, 2006, and a Notice of Intended Amendment of Stormwater User Fee Schedule. The Notice was sent to the Mayor and City Councilors, as notification that I intended to increase the fees in the Stormwater User Fee Schedule that had been established by Administrative Order No. 58- OS-03-F on June 12, 2005. C. Notice was provided to the news media, any person who had requested notice, and to interested governmental agencies (including the United States Environmental Protection Agency, the i Department of Environmental Quality, MWMC, and the Eugene Water & Electric Board). In j addition, the Notice was posted at two locations at City Hall on April 28, 2006, and published in the 'Register-Guard, a newspaper of general circulation within the City, on April 29 and 30, 2006. The ',I Notice was also made available for inspection by interested persons at the offices of the Public Works Department, 858 Pearl Street, Eugene, Oregon, 97401, during normal business hours (8:00 a.m. to 5:00 p.m., Monday through Friday, exclusive of holidays). D. The Notice provided that written comments would be received for a period of ten days from the first date of publication and posting, and that comments would also be received at the public hearing to be held in the McNutt Room of Eugene City Hall, 777 Pearl Street, Eugene, Oregon, "97401, on May 9, 2006, between 3 PM and 4 PM. During the public hearing, three attendees (Charles Biggs, Gary Heldt, and Zach Vishanof fl entered into aquestion/answer period 'with City staff. Gary Heldt, who works at the 4J School District, submitted written comments ,expressing that the proposed increases were unjustified and he encouraged a thorough review of ' administration costs associated with the program. He also believed that there should be a reassessment as to which public works functions are funded by stormwater utility fees. However, since these comments did not express objections to specific fees or suggest proposals for alternative I, fees, no changes are being made to the proposed fees as a result of the comments.
