ADMINISTRATIVE ORDER N0.58-06-03-F <br /> of the <br /> City Manager of the City of Eugene <br /> AMENDMENT OF STORMWATER USER FEE SCHEDULE AND REPEAL <br /> OF ADMINISTRATIVE ORDER N0.58-OS-03-F. <br /> <br /> I' <br /> The City Manager of the City of Eugene finds as follows: . <br /> A. Section 6.411 of the Eugene Code, 1971 (EC), authorizes the City Manager to <br /> determine and set fees and charges to be imposed by the City for wastewater service, regional <br /> wastewater service, and stormwater service. <br /> B. In accordance with the procedures of EC 6.411, I issued Administrative Order No. 58- <br /> 06-03 on April 21, 2006, and a Notice of Intended Amendment of Stormwater User Fee Schedule. <br /> The Notice was sent to the Mayor and City Councilors, as notification that I intended to increase the <br /> fees in the Stormwater User Fee Schedule that had been established by Administrative Order No. 58- <br /> OS-03-F on June 12, 2005. <br /> C. Notice was provided to the news media, any person who had requested notice, and to <br /> interested governmental agencies (including the United States Environmental Protection Agency, the <br /> <br /> i Department of Environmental Quality, MWMC, and the Eugene Water & Electric Board). In <br /> <br /> j addition, the Notice was posted at two locations at City Hall on April 28, 2006, and published in the <br /> 'Register-Guard, a newspaper of general circulation within the City, on April 29 and 30, 2006. The <br /> ',I Notice was also made available for inspection by interested persons at the offices of the Public <br /> Works Department, 858 Pearl Street, Eugene, Oregon, 97401, during normal business hours (8:00 <br /> a.m. to 5:00 p.m., Monday through Friday, exclusive of holidays). <br /> D. The Notice provided that written comments would be received for a period of ten days <br /> from the first date of publication and posting, and that comments would also be received at the <br /> public hearing to be held in the McNutt Room of Eugene City Hall, 777 Pearl Street, Eugene, <br /> Oregon, "97401, on May 9, 2006, between 3 PM and 4 PM. During the public hearing, three <br /> attendees (Charles Biggs, Gary Heldt, and Zach Vishanof <br /> fl entered into aquestion/answer period <br /> 'with City staff. Gary Heldt, who works at the 4J School District, submitted written comments <br /> ,expressing that the proposed increases were unjustified and he encouraged a thorough review of <br /> ' administration costs associated with the program. He also believed that there should be a <br /> reassessment as to which public works functions are funded by stormwater utility fees. However, <br /> since these comments did not express objections to specific fees or suggest proposals for alternative <br /> I, fees, no changes are being made to the proposed fees as a result of the comments.
