Attachment 1 <br /> ADMINISTRATIVE ORDER N0.58-07-03 <br /> of the <br /> City Manager of the City of Eugene <br /> CONCERNING NOTICE OF INTENDED INFLATIONARY <br /> ADJUSTMENT OF SYSTEMS DEVELOPMENT CHARGES FOR LOCAL <br /> WASTEWATER SYSTEM, STORMWATER SYSTEM, AND <br /> TRANSPORTATION SYSTEM AND REPEALING ADMINISTRATIVE <br /> ORDER NOS. 58-04-04-F AND 58-06-02-F. <br /> The City Manager of the City of Eugene finds as follows: <br /> A. Section 2.020 of the Eugene Code, 1971, authorizes the City 1~Ianager of the City <br /> of Eugene to determine and set fees and charges to be imposed by the City for services, goods, <br /> use of municipal property, and licenses and permits. Eugene Code 7.710(5) authorizes the City <br /> Manager to adopt by administrative order changes to Systems Development Charge (SDC) rate <br /> factors and cost indices. <br /> B. The SDC Methodologies were adopted by Resolution No. 4740 on September 23, <br /> 2002, and have subsequently been amended, most recently by Resolution No. 4876 effective on <br /> July 12, 2006. <br /> C. SDCs for Local Wastewater S stem Stormwater S tem and Tr <br /> Y ~ ys ansportation <br /> System were adjusted- for inflation by Administrative Order No. 58-06-02-F, effective April 3, <br /> 2006, and an inflationary adjustment of SDC rates for Regional Wastewater System was adopted <br /> by Resolution No. 4883, effective August 1, 2006. <br /> D. In accordance with the procedures set forth in Sections 2.020 and 7.710(5) of the <br /> Eugene Code, 1971, I propose to amend portions of the Systems Development Charges by <br /> implementing a 3.1 % inflationary increase to the Local Wastewater System, Stormwater System, <br /> and Transportation System, as set forth in the Notice attached as Exhibit A.. This inflationary <br /> adjustment is based on the nationa120-city average Construction Cost Index as published by the <br /> Engineering News-Record. <br /> E. I find that the proposed inflationary adjustment to the Systems Development <br /> Charges set forth in Exhibit A are consistent with adopted policies of the City, in conformity <br /> with applicable state law, authorized by EC 7,710(5), and should be implemented effective April <br /> 3, 2007. <br /> E. Upon adoption of the amended fees, I find that: (1) the final Administrative Order <br /> and amended fees should be appended to the Systems Development Charge Methodologies; (2) <br /> Administrative Order No. 58-06-02-F should be repealed; and (3) as a "housekeeping" matter, <br /> Administrative Order No. 58-04-04-F, which adopted inflationary adjustments in 2004, should <br /> be repealed because it has been superceeded by Resolution No. 4827. <br /> <br /> Administrative Order -Page 1 <br /> <br />
