• Changes the directive from "compensating" the cities for the regional facilities to <br /> "facilitating timely transfer of ownership" with same consideration of funding <br /> equity among all sewer users <br /> • Moves some sections of text for better organization, without modifying intent <br /> • Incorporates 2004 Facilities Plan as basis for improving facilities, and specifies <br /> when and what types of updates will be submitted for review and approval by the <br /> governing bodies <br /> • Strengthens language about collection and remittance of revenues in response <br /> to Financial Advisor concerns <br /> • Eliminates provisions referencing trigger for capacity (section 9) because the <br /> Facilities Plan and its updates replace need for-this provision <br /> • Deletes outdated provisions for compensation from the 3 jurisdictions for "initial <br /> expenses" <br /> • Deletes user charge reference to federal regulations (40 CFR 35.929) because <br /> previous federal restrictions under the grants no longer apply <br /> • Removes 30-day notice of termination; leaves one year notice requirement, and <br /> further restricts Eugene and Springfield from terminating when outstanding debt <br /> requiring long-term commitment of revenues is required <br /> • Modifies the MWMC dispute resolution process <br /> RECOMMENDATION/REQUESTED ACTION: <br /> Timely approval of these IGA modifications is an important early step in implementing <br /> <br /> the newly adopted MWMC Facilities Plan. Staff is requesting feedback regarding the <br /> proposed changes, and guidance on an expeditious path to approval. <br /> _ <br /> <br />
