At your meeting, staff and legal counsel will seek your guidance on timely <br /> approval processes that meet each of the three jurisdictions' protocols. <br /> BACKGROUND: <br /> The submittal of this package of proposed IGA revisions is the culmination of several <br /> years of work reviewing the agreement and determining appropriate changes to meet <br /> operational conditions and public policy parameters that have evolved over the past 25 <br /> <br /> years. The proposed changes have been developed by the Regional Wastewater <br /> Program staff and legal counsel, and have been reviewed by legal counsel for all three <br /> partner jurisdictions and the new MWMC Financial Advisor. The revisions have been <br /> reviewed and endorsed by the Eugene and Springfield Public Works Directors, and are <br /> now being submitted for approval. <br /> <br /> The changes, while expansive, are generally intended to update the IGA to include <br /> references to current adopted documents and plans (thereby obviously deleting <br /> references to outdated information, plans, or other documents). The changes do not <br /> reflect or implement any changes in the Commission, its relationship to the governing <br /> bodies, its purview, or its authority. However, at the request of the new MWMC <br /> Financial Advisor, changes are recommended to strengthen the assurance that <br /> adequate rates and fees will be established to cover long-term borrowing, and that <br /> revenues will be collected and forwarded to MWMC. <br /> HIGHLIGHTS OF SIGNIFICANT UPDATES/CHANGES: <br /> • Updates the language to reflect adopted Metro Plan terms and policies <br /> • Updates the financing guidance by replacing Exhibit B (which refers to the 1992 <br /> Financial Plan, the CSD and GO bonding) with the 2003 Financial Plan <br /> (including the financial policies and revenue bonding strategy) <br /> <br />
