132 Insurance. The risk of public liability claims and loss or damage to the <br />Work shall be borne by each member of the Artist team until delivery of Work to City <br />and acceptance by City. Each member of the Artist team shall maintain personal <br />liability and property damage insurance that protects each member of the Artist team <br />and City and its officers, agents and employees from any and all claims, demands, <br />actions and suits for damage to property or personal injury, including death, arising <br />from Artist teams' work under this Agreement and until City's final acceptance of the <br />Work. Each member of the Artist team shall maintain in force for the duration of this <br />contract the insurance the coverages specified below. A copy of each policy or a <br />certificate satisfactory to City shall be delivered to City prior to commencement of the <br />Work. Unless otherwise specified, each policy shall be written on an "occurrence" form <br />and shall contain an endorsement entitling City to not less than 30 days prior written <br />notice of any material change, nonrenewal or cancellation. The adequacy of all <br />insurance required by these provisions shall be subject to approval by City's Risk <br />Manager. Failure to maintain any insurance coverage required by this contract shall be <br />cause for immediate termination of this contract by City. <br />13.2 a. Personal Liability. Each member of the Artist team shall maintain <br />a broad form personal liability insurance policy with coverage of not less than <br />$500,000 combined single limit per occurrence, with aggregate of $1 million, for <br />bodily injury, personal injury or property damage. Such policy shall contain a <br />contractual liability endorsement to cover each member of the Artist team's <br />indemnification obligations under this contract. The policy shall also contain an <br />endorsement naming City as an additional insured, in a form satisfactory to City, <br />and expressly providing that the interest of City shall not be affected by either <br />member of the Artist team's breach of policy provisions. <br />13.2 b. Automobile Liability. Each member of the Artist team shall <br />maintain an automobile liability insurance policy with coverage of not less than <br />$500,000 combined single limit per occurrence, with aggregate of $1 million, for <br />bodily injury, personal injury or property damage. The coverage shall include <br />both hired and non-owned auto liability. The policy shall also contain an <br />endorsement naming City as an additional insured, in a form satisfactory to City, <br />and expressly providing that the interest of City shall not be affected by either <br />member of the Artist team's breach of policy provisions. <br />13.3 Artist team shall notify the City when Work is completed. <br />13.4 Upon completion of the Work, Artist team will provide instructions for the <br />care and maintenance of the Work, including what cleaning products to use and not to <br />use, and shall provide photographic documentation of the Work to City. <br />14. City Responsibilities. <br />14.1 City shall be responsible for all expenses, labor, and equipment to <br />prepare the site for installation of the Work. <br />14.2 City shall provide the 8' concrete octagonal base (in consultation with the <br />Artist team). <br />Page 7 <br />
