14.3 City shall reasonably maintain and protect the Work against the ravages <br />of time, vandalism and normal usage. Reasonable maintenance of the Work will not <br />require procedures substantially in excess of those described in the maintenance <br />recommendations submitted by Artist team to City in accordance with Section 13.4. <br />15. Warranties. <br />15.1 Warranties of Title. Artist team represent and warrant that: (1) the Work <br />is solely the result of the artistic effort of Artist team; (2) the Work is unique and original <br />and does not infringe upon any copyright; (3) the Work or a duplicate thereof has not <br />been accepted for sale elsewhere; and (4) the Work is free and clear of any liens from <br />any source whatever. <br />15.2 Warranties of Quality and Condition. Artist team warrants for a period of <br />three (3) years after execution of the Document of Title and Acceptance that: (1) the <br />Work, as fabricated, will be free of defects in material and workmanship, including any <br />defects consisting of "inherent vice" or qualities which cause or accelerate deterioration <br />of the Work, (2) the Work will be durable and in a condition to allow proper installation, <br />and (3) the Work will be free of inherent hazards that could cause injury or property <br />damage or put the City at unreasonable risk from a public liability standpoint. For any <br />claim arising during the warranty period, Artist team shall, at no cost to City, cure <br />reasonably and promptly the breach of any warranty which is curable by Artist team <br />and which cure is consistent with professional conservation standards (including, for <br />example, cure by means of repair or re-fabrication of the Work). <br />16. Re air. <br />With respect to any repair or restoration of the Work not covered by the warranty <br />provided in Section 15, Artist team shall be given the first opportunity to accomplish <br />such repair or restoration, provided Artist team and City are able to agree on a fee to <br />be paid to Artist team for such restoration or repair. City may proceed with repair or <br />restoration if Artist team cannot be located after a reasonable effort to do so is made, or <br />if a fee cannot be reasonably agreed upon between City and Artist team. <br />17. Standard Contract Provisions. <br />Artist team shall comply with City's Standard Contract Provisions, a copy of <br />which is attached hereto as Exhibit B. <br />18. Comaliance with Laws. <br />Artist team shall comply with all applicable federal, state and local laws, rules, <br />ordinances and regulations at all times and in the performance of the Work. <br />~. <br />Page 8 <br />
