WHEREAS, the City owns and manages a complex of wetlands in the <br /> <br /> ~r west Eugene area in cooperation with the Bureau of Land Management <br /> and The Nature Conservancy under a Memorandum of Agreement. <br /> WHEREAS, the West Eugene Wetlands partnership has developed the <br /> highly specialized staff and facilities required to collect, grow- <br /> out, store, transport, clean, and propagate seeds and plant <br /> materials. <br /> NOW, THEREFORE, THE PARTIES AGREE AS FOLLOWS: <br /> 1. SCOPE OF WORK. The City agrees that it will collect, grow- <br /> out, store, transport, clean, and propagate native wetland and upland <br /> seeds and plant materials needed for the Amazon Creek Wetlands <br /> Restoration Project, and treat the Project for control of non-native <br /> weedy species, in accordance with the attached scope of work. Work <br /> under this agreement is subject to the availability of funds in each <br /> Federal fiscal year. If required and funds are available, the <br /> 'fir Government shall issue a Task Order for work to be conducted under <br /> this Cooperative Agreement for succeeding fiscal years. <br /> 2. COMPENSATION. The Government agrees to reimburse the City <br /> for the costs of obtaining, treating and handling native seeds and <br /> plants provided under the terms of this agreement. Such costs shall <br /> not exceed $100,000 for Federal fiscal year 2000, unless agreed in <br /> writing by the parties hereto, and will be subject to negotiation for <br /> succeeding fiscal years. To the extent that Federal funds are <br /> obligated by this Agreement, such funds and obligations are in all <br /> cases conditioned upon the availability of appropriated funds from <br /> Congress. <br /> 3. OBLIGATION OF THE GOVERNMENT; BILLING PROCEDURES <br /> The Government is not obligated for any work performed under this <br /> agreement until the agreement is signed by the parties.
