<br /> DRAFT 6/14/2000 <br /> COOPERATIVE AGREEMENT <br /> BETWEEN <br /> THE UNITED STATES OF AMERICA <br /> AND <br /> THE CITY OF EUGENE, OREGON <br /> FOR ACQUISITION OF NATIVE PLANTS AND SEEDS FOR THE AMAZON CREEK <br /> WETLANDS RESTORATION, SECTION 1135 PROJECT <br /> This agreement is entered into this th day of 2000, <br /> by and between the UNITED STATES OF AMERICA (hereinafter called the <br /> "Government", represented by the District Engineer, U.S. Army <br /> Engineer District, Portland, executing this agreement, and the CITY <br /> OF EUGENE, OREGON (hereinafter called the "City") represented by <br /> the Director of the Department of Public Works <br /> WHEREAS, modification of existing Corps of Engineers projects <br /> for the purpose of environmental restoration is authorized by Section <br /> 1135(b) of the Water Resources Development Act of 1986, Public Law <br /> 99-662, as amended, and by Section 107(4) of the Water Resources <br /> Development Act of 1996, Public Law 104-303; <br /> WHEREAS, the Government and the City have entered into a Project <br /> Cooperation Agreement (dated 26 October 1998) for implementation of <br /> the AMAZON CREEK WETLANDS RESTORATION PROJECT (hereinafter the <br /> "Project); <br /> WHEREAS, the Project, as described in the Amazon Creek Section <br /> 1135 Project Modification Report Supplement & Revised Environmental <br /> Assessment (dated June 1997, updated January 1998) and approved by <br /> the Acting Chief, Planning Division, Directorate of Civil Works on <br /> March 12, 1998, includes the restoration of approximately 141 acres <br /> of native Willamette Valley wet prairie vegetation. <br /> WHEREAS, Successful project implementation of the restoration of <br /> native wet prairie ecosystems will require the removal of non-native <br /> invasive species and the extensive planting, seeding and treatment of <br /> native upland, riparian and wetland plants and seeds. <br /> 1 <br /> <br />
