My reading of the original
easement is that a driveway across the easement would be permissible. Best way to accomplish this might
be a revocable permit; it would be up to them to verify that they have access to the Bridle Trail via Vivian
Drive. I don't see that County would have any involvement in such a permit. jf
From: MEDLIN Johnny R
To: ETTER John F; FERGUSON Joe M; Haniuk, Walt (RIS1)
Cc: HAMMITT Bob
Subject: RE: Title questions along Bridle Trail
Date: Monday, November 28, 1994 7:59AM
Hi folks,
I concur with what John is suggesting below. Since there
seems to be little risk of development activity at this point
in time waiting to see how the various private interests in
the neighborhood work the issue seems a good course of action
for us.
Thanks Johnny
From: ETTER John F
To: FERGUSON Joe M; Haniuk, Walt (RIS1)
Cc: MEDLIN Johnny R
Subject: Title questions along Bridle Trail
Date: Tuesday, November 22, 1994 1 :50PM
I caught Johnny in the hall and briefed him on our meeting,
and projected higher cost on the work to be done. He
suggested that we didn't have anything to lose immediately by
waiting to see what the outcome of the private fund raising
effort might be. An optomistic scenario might go as follows:
1. Frank Anderson deeds his half, which include the trail
easement, to LCC by 12/31/94.
2. LCC has the burden of marketing it to get whatever they
can out of it. It is during this period that it's true market
value will be determined. This could take a number of months.
3. In a year or two, if it turns out to be as little as one
developer said (nothing in terms of residential development)
then the private fund raisers might acquire it for a pitance.
If the whole former Anderson parcel is acquired and turned
over to the City as open space for park purposes, then we
wouldn't need to become involved in relocating the easement.
The easement could remain as is forever; we put the trail(s)
wherever seems best on the larger parcel.
4. The Cummins piece is not crucial to creating the Amazon -
Ridgeline connection if things develop as described above. It
becomes more crucial to Cummins, therefore, to pursue the
chain of title question. He is the one who could benefit
immediately from the work that Tucker could do.
Page 1
