When we <br /> talked it sounded like the role of the City would not include determination of appropriate value or involvement in <br /> negotiation with the owner. I believe it would be awkward for the City to assist in negotiations between AS and <br /> the property owner. We might be able to have an independent appraisal done as part of our contribution to this <br /> effort that could be used by the AS in their negotiations with the owner. (Jean Tate might have some ideas about <br /> how negotiations could be handled as well.) 2. I am not clear about your mention of"seed"support for this <br /> effort. Are you thinking about a City financial contribution to the acquisition fund? If so that could be a part of <br /> our letter of understanding but would require Council direction. 3. That brings us to your third question. I don't <br /> believe there is a need for Council action to accomplish the actions I described in my first memo because there <br /> is no significant out of pocket expense to the City and it is all consistent with the Parks Master Plan. If we get <br /> into paying for an appraisal or providing financial contribution for the acquisition then I believe we would want to <br /> notifiy Council to see if they have any concerns. I am assuming we would be able to use SDC funds if there <br /> were to be a financial contribution. 4. The timeline would be driven by the ability of the non-profit to raise funds. <br /> That timeframe would likely be driven by the amount necessary to meet the seller's demand. If you want to have <br /> the staff actively involved in fund raising for this effort that would require an assessment of staff availability and <br /> associated costs and would have to be approved by Council. 5. At this point I am comfortable playing point <br /> myself until we have sorted out exactly what staff support would be required. As a beginning point the Audubon Society(AS), the <br /> private property owner and the City could sign a letter of <br /> understanding that lays out the interests of the AS in raising <br /> funds to acquire and ensure that the property comes under <br /> public ownership, the interests of the property owner to sell, <br /> and the interests of the City to acquire the property as <br /> Page 1 <br />
