Once the price of sale has been negotiated by the <br /> other two parties and fund raising is underway, a fairly <br /> simple way to handle the actual sale and transfer of deed <br /> would be through an Escrow agreement whereby the Audubon <br /> Society agrees to convey funds into an escrow account, the <br /> private property owner agrees to convey an unincumbered deed <br /> to the City, and the City agrees to accept the unincumbered <br /> deed as park land. That way everyone has their interests <br /> protected. I am doing some final checking on the procedure <br /> for acceptance of a donation by the City and so far it appears <br /> that there is no formal process required particularly since <br /> the need has been identified in the Parks Master Plan. <br /> Throughout this process the role of the City could be to <br /> facilitate meetings (notification, agenda prep., minutes, <br /> space) and be willing to accept the donation. <br /> Please let me know if you think I've missed something in your <br /> understanding of how all of this might work.
