identified in the Parks Master Plan.
2. Once the price of sale has been negotiated by the
other two parties and fund raising is underway, a fairly
simple way to handle the actual sale and transfer of deed
would be through an Escrow agreement whereby the Audubon
Society agrees to convey funds into an escrow account, the
private property owner agrees to convey an unincumbered deed
to the City, and the City agrees to accept the unincumbered
deed as park land. That way everyone has their interests
protected. I am doing some final checking on the procedure
for acceptance of a donation by the City and so far it appears
that there is no formal process required particularly since
the need has been identified in the Parks Master Plan.
Throughout this process the role of the City could be to
facilitate meetings (notification, agenda prep., minutes,
space) and be willing to accept the donation.
Please let me know if you think I've missed something in your
understanding of how all of this might work. It seems to me
that a lot of what is involved is on the private side and is
not an issue for the City. Good luck with your meeting.
Thanks, Chris
Page 2
