11/14/03 <br /> I happened to be home mid-morning and noticed equipment in the field. I walked out and <br /> John Clark(Turf and Grounds Supervisor) came over and met me. He said they were <br /> removing trees so that they can take better care of the property. I asked how far are you <br /> going? He said they are taking all out except flagged ones. What a waste, 500 trees 2/3 <br /> of them exceed the cities standard of an 8"tree. Some were 25 feet tall! They cut them <br /> down and chipped them. I asked if they were planning on removing the black walnuts and <br /> he said yes except for the 3 or 4 that are flagged. You have had plenty of time to remove <br /> them. Ttold him that we were told we had 10— 15 years before anything was done so he <br /> better not touch our trees. He changed the subject by asking where the property line was. <br /> I said you tell me where it is, as the property pins where supposed to be in 1 '/Z years ago. <br /> He asked"well, are those trees on the park side?" I said that I had no idea. I am about <br /> ready to ask to reverse this sale. He said, "You can't do that. Hasn't anyone from the City <br /> called you since we last talked?" I told him No, why? He just walked away. <br /> 11/16/03 <br /> Went out to see what was left of the 500 trees. There were little stumps in places where <br /> they pinched off young trees. The stumps were 8 — 10 inches high, perfect for some kid to <br /> fall on and get injured. <br /> 2/23/04 <br /> The few pine trees they left us couldn't support the snow on their own and some broke <br /> off. Today received a letter from our lender which read in part"you had indicated that the <br /> City of Eugene, purchased a portion of your acreage but I don't see that reflected in the <br /> county record. It will be a requirement of the loan to get a clear property description. <br /> 2/14/04 <br /> Went down to County tax records. Todd, from records, said someone forgot to record the <br /> sale of the property to the City. He called back the next day and said it may take a year to <br /> get corrected. <br /> 3/31/04 <br /> I mowed the north part of the park property. It's a real mess again! <br /> Melissa Butterfield from Cascade Escrow called to say we have no legal access to our lot <br /> and they can not fund the loan with us being landlocked. I went downtown and asked to <br /> see Russ Royor. I explained to him that I told Lloyd Williams over and over we need an <br /> easement through to River Loop 1 and he said we'll get you access we will not leave you <br /> landlocked. (Two years later we are facing another problem created by the City) I told <br /> him to please give our Escrow what ever they need to complete the loan, or I am holding <br /> the City responsible; I talked to him about the many meetings with Lloyd Williams and <br /> parks people and how disappointed I was with them. The only reason we even talked to <br /> the City was our Attorney said they want your piece of property and if you don't work <br /> with them they(the City) will condemn the land. Russ Royer said"We rarely do that and <br /> I don't think it was our intention in your case." WHAT?? I said I'd like to reverse this <br /> sale. Russ said, "That rarely happens." I told him that we would both be much happier! If <br /> you went home tonight and a bulldozer was plowing through your house,then you would <br /> have some kind of feeling how we feel. We've owned this land since 1979. Then I asked <br /> if he have ever been to my place, and He answered No. <br /> 6 <br />
